AN ORDINANCE CALLING AND PROVIDING FOR, AND GIVING NOTICE
OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF GILROY, STATE
OF CALIFORNIA, ON THE OF -4 1913,
THE OBJECT BEING TO SUBMIT TO THE QU.gLIFIED ELECTORS OF SAID
CITY A PROPOSITION TO 1110UR A BONDED DEBT BY SAID CITY OF GILROY
FOR THE PURPOSE OF THE ACQUISITION, CONSTRUCTION AND COMPLETION
OF THE IMPROVEMENT OF THE MUNICIPAL WATER !'CORKS OF SAID CITY,
AND ALSO FOR SHE PURPOSE OF THE ACQUISITION OF FIRE APPARATUS
FOR SAID CITY.
WHEREAS the Mayor and Common Council of the City of Gilroy
did on the 15th day of January 1913, by a vote of more than two—
thirds of said Common Council, adopt a resolution determining
that the public interest end. necessity demanded the acquisition,
construction and completion of improvement to the Municipal
water works of said City, and that the cost thereof would exceed
the ordinary annual income and revenue of the Municipality,
Ane 1�hereas the Mayor and Common Council of the City of
Gilroy did, on the 15th day of January 1913, by a vote of more
than two — thirds of said Common Council adopt a resolution deter—
mining that the public interest and necessity demanded the
acquisition of fire aap.paratus for said City, and that the cost
thereof would exceed the ordinary annual income and revenue of
the Ifunici;9ality,
And Whereas both of said Resolutions were on the 15th day

of January^ duly approved by the Mayor of the City of Gilroy who
is the Executive of said City

NOW THEREFORE, the Ma,,,ror and Cormion Council of the City of
Gilroy do ordain as follows:—
Section 1.
A special election is hereby called and ordered to be
held in the City of Gilroy, State of California, on C--/—_�
till d day of February 1913, the object being to sub ` t
v to the nualified electors of the City of Gilroy a question of
incurring a bonded indebtedness by the ritir of Gilroy of Thirtr —t!*.o
TftouFsand Dollars. The purposes for vdhich said bonded debt
is to be incurred are as follows:
let. A bonded indebtedness of Twenty five thousand Dollars
to be inourred for the purpose of the acquisition, construction
and completion of improvements to the Municipal water works of
the City of Gilroy, the estimated cost of which is Tlventy —five
thousand Dollars, said. stun being; the amount of the principal of
the indebtedness to be incurred therefor.
2nd. A bonded indebtedness of Seven thousand Dollars
to be incurred for the purpose of the aernaisition of fire apparatus
for the said City of Gilroy, the estimated cost of which is
Seven thousand Dollars, said. slim being the amount of the prinoi—
pal of the indebtedness to be incurred therefor.
The rate of interest to be paid upon the bonded indebtedness
proposed to be incurred will be five per centum, per annum,
payable semi -- annually.
The amount of the principal of the indebtedness to be
incurred on said first proposition is the slim of 025000. and
the rate of interest to be paid on said indebtedness is Five
per centum per annum, payable semi -- annually; the bonds thereof

to be issued, numbered and made payable as hereinafter specified.
The amount of the pri.noipal of the indebtedness to be in-
ourred on said second proposition is the sum of 47000. and the
rate of interest to be paid on said indebtedness is Five per
centum per annum payable semi. -- annually; tyre bonds thereof to
be issued, numbered and made payable as hereinafter specified.
NOTICE IS HEREBY GIVEN that a special election in and for
the City of Gilroy has been and is hereby ordered and called by
the Mayor and Common Council of said City for the purpose of
submitting to the qualified voters of said City the following
propositions, to-- wit: —
lot. The proposition of incurring a bonded indebtedness
of 425000, in United States Gold Coin, for the purpose of the
acquisition, construction and completion of improvements to the
Municipal Water works of said City, said improvements to consist
of putting a cement concrete floor in the City water reservoir,
and covering said City Water reservoir with a suitable covering
to protect the water therein from the rays of the sun, and the
replacement of old water mains and service pipes with new mains
and service pipes, the principal of said indebtedness to be
425000. and to bear interest at the rate of Five per centum per
annum, payable semi — annually, on the first day of January and
the first day of July of each year.
The bonds of said City for said � 25000. to be issued and
sold bearing such interest, shall be of the denomination of
Five hundred (4500. ) Dollars each, and three of said bonds shall
be paid each and every year on the first day of January thereof,
together with interest on all sunr; unpaid at such date.
Sample ballots containing the above matter required to be
Printed thereon shall be supplied to the electors of said City
by the City Clerk, but a failure on the part of any elector to
receive such sample ballot t3hall not be held to invalidate the
election or affect in any manner the legality of any bonds that
may be authorize=d thereat.
Section 3.
Any qualified elector of the City of Gilroy who Iras com-
plied with the law governing; the registration of votes, may vote
at said special election for or against either proposition
submitted.
To vote in favor of and thereby authorize the incurring of
a bonded debt for the pi.irpose set forth in eGioh proposition he
shall stamp -a cross (X) in the square to the right of the word
YES printed opposite to the proposition. To vote against,
and refuse to authorize the incurring of a bonded debt for the
purpose set forth in such proposition, he shall stamp a cross (X)
in the square to the right of the cord "NO" printed opposite the
Proposition.
Each cross (x) stamped 'in the square to the right of the
vrord "YES" shall be counted as a vote in favor of and to a_i.zthorize
the incurring of the bonded indebtedness for the Purpose set
forth in the proposition opgosiite to ! hioh such cross (X) is
stamped, and each cross (X) stamped in the aquare to the right
Of the 1,7,ord "NO" shall be counted as a vote not in favor of,
and a fefusal to authorize the incurring of a bonded indebtedness
i, for the purpose set forth in the proposition opposite to which

Section 4.
There shall be one election precinct within said City

for the purpose of holding said special election, Which shall
be and the same is hereby designated "Gilroy, Election Precinct
No. 1x and the boundaries thereof shall be the boundaries of
the City of Gilroy, and which said .precinct is hereby established.
The officers to conduct said election are hereby appointed
and designated an follows:

The polling place for such election shall be at the
City Hall in said City.
The City Clerk is hereby directed to procure all suPPlies
that may be necessary to properly and lawfully conduct said
special election.
'Mien the Oolls are closed. the officers of election shall
count the ballots cant at such especial election and canvass the
votes cast respectively for and against the propositions herein
stated and make return thereof to the Mayor and Common council
of the City of Gilroy in the time, form and manner required for
the counting, cancassing and returning of votes cast at other
Munieiapl elections in said City of Gilroy,
Section 5.
This Ordihanee shall be published once each week for
two successive weeks prior to said day of election in the
which is a newspaper of general eir--
culation, printed and published less than six days a week in
said City of Gilrml, and this ordinance and such publication

shall be the notice of said election.
Section 6,
This Ordinance shall take effect immediately.
Passed this 2%th day of January A. D. 1913 by the Common Council
of the City of Gilroy, by the following vote.
