AN ORDINANCE CALLING AND PROVIDING FOR, AND GIVING NOTICE
OF A SPECIAL ELECTION TO 13E HELD IN THE CITY OF GILROY, STATE
OF CALIFORNIA, ON THE 1-7 e DAY OF MAY A. D. 19139

THE OBJECT BEING TO 971?3MIT TO THE QUALIFIED ELECTORS OF SAID
CITY A PROPOSITION TO INCUR A BONDED DEBT BY SAID CITY OF GILROY
FOR THE PURPOSE OF THE ACQUISITION, CONSTRUCTION AND COMPLETION
OF A MUNICIPAL IMPROVEMENT TO -WIT: THE PAVING OF MONTEREY STREET
IN SAID CITY OF GILROY,
WHEREAS the Mayor and Cormnon Council of the City of Gilroy,
did on the 7 "-day of April A. D. 19139 by a vote of more than
t1ro -- thirds of said Common Coir,neil a (loft a Resolution determining
that the public interest and necessity do nanded the acquisition,
construction and completion of a municipal improvement to said
City, to- wit: -- the - _paving of a strip twenty -four feat wide in
the center of HGnterey Street, in the City of Gilroy, which
twenty -four foot strip shall extend on Monterey Street from the
Northerly limits of said City of Gilroy to the Southerly limits
Of said City, and that this costs thereof would be too great to
be paid out of tie ordinary annual income and revenue of the
Municipality.
AND WHEREAS said Resolution was on the 7� day of April 1913,
duly a9pr0v, -3d by the Mayor of the City of Gi.troy, who is the
Executive of said City.
NOW THEREFORE, the Mayor and Common Council of the City of
Gilroy do ordain as follows: - -
Section 1.
A sDeeial election is hereby onlieri and Ordered to

be held. in the City of Gilroy, County of Santa Clara, State of
California, on the - %day of May A. D. 1913, the
Object being to submit to the qualified electors of the City of
Gilroy the proposition of incurring a bonded indebtedness by the
City of Gilroy of Thirty -five thousand Dollars, in gold coin of
the United States of America, for the pur,_po se of the acquisition,
construction and completion of a. riunicipal improvem6nt, viz:-
The paving of a strip in the center of Monterey Street in the
City of Gi 1roy, County of Santa Clara, State of California, which
strip shall be twenty -foitr feet wide and shall extend. on Monterey
Street from the Nortlgerly limits of said City of Gilroy to the
Soixtherly limits of said city.
That the estimated cost of said improvement is 434806.
The principal of the indebtedness nro?poswA to be inourred is
435000,, and the rate of interest to be maid upon the bonded
indebtedness proposed to be incurred 1p►ill be Per centum
per annum, payable semi— annually, on the first d.aIr of January
and the first d.ay of July of each .year.
The bonds of said City of Gilroy for said 435000. to be
issued and sold shall be of the denomination of Five Hundred WO06)
Dollars each and a certain number of said bonds, as hereinafter
provided, shall be paid each and every year, on the first day Of
January thereof, together with interest on all sums unpaid at
such date.
Said bonds shall be numbered consecutively from One to
Seventy, and shall be payable at the office of the Treasurer of
the City of Gilroy, in Gilroy, California, as follows:- -

section 2.
The special election hereby called and ordered to be
held shall be held and conducted and the vote thereat received
and canvassed, And the returns thereof made, and the result
thereof ascertained, determined and declared as herein provided,
and according to the laws of the State of California, providing
for and governing elections in the City of Gilroy.
The polls for such election shall be opened at 6 O'clock
A. M. on said t X'79day of lday 1913, and shall rernain open until
the hour of 6 otclock P. V. of said day, at which time said
polls shall be closed.
The ballots to be used at said election shall be such as
may be required by law to be used thereat, and in addition to
any other matter racpiired by law to be printed thereon, there
shall be printed the folio- ,ing:

To vote for a proposition and thereby authorize the in
eirring of a bonded indebtedness to the amount Of.and for the
Purpose stated in such proposition, stamp a cross (7-0 in the
blank space to the right of the word "YES"
To vote against a proposition znd thereby refuse to
authorize the incitrr. ing of a bonded indebtedness for the amount
of, and for the rntrPoge stated in :such proposition stamp a cross
M in the blank space to the right of the word "NO ".
Also said ballot shall have printed thereon the following:
Shall the City of Gilroy incur a bonded !debt to
the amount of 435000. for the purpose of the acquisition
construction and completion of a Municipal improve-

Sample ballots containing the above matter required to be
printed thereon shall be supplied to the electors of said City
by th. o City Clerk, but a failure on the part of any elector to
receive such sa<*rmle ballot shall not be held to invalidate the
election, or effect ill any manner the legality of any bonds that
may be authorized thereat.
Section 3.
Any qualified elector of the City of Gilroy iAho has
complied with the lair governing the registration of voters may
'Vote at said special election for or against the proposition
therein submitted.
To vote in favor of and thereby authorize the incurring of
a bonded r?_ebt for the purpose set forth in such proposition he
shall stamp a cross (X) in the square to the right of the 17ord
"YES" printed opposite the -proposition.
To vote against, and refuse to authorize the inei.Lrring of
a bonded debt for the purpose set forth in such proposition he
shall stamp a cross (x) in the square to the right of the word
"NO" printed opposite the proposition.
Each cross (X) stamped in the s sure to the right of the
'?word "YES" shall be counted as a vote in favor of and to author-
ize the incurring of the bonded indebtedness for °,jig ��ur�ofie
set forth in the proposition opposite to which such cross (X)
irs stamped, and each cross (x) ataMped in the square to the
right of the word "NO" shall be co,anted as a vote not in favor
Of and a refusal to - ra,thorize the incurring of a bonded indebted-

which such cross (X) is stwaped.
Section 4.
There shall be one *election precinct within said City
ofGilroy for the purpose of holding said special election, which
shall be, and the same is hereby designated "Gilroy Election
Precinct No. 1" and the boundaries shall be the boundaries of
the City of Gilroy, and ivIlieh said ;.precinct is hereby established.
The officers to conduct said election are hereby appointed
and designated as follows:-

The polling place for such election shall be at the City
Hall at the Northeast corner of Monterey and Sixth streets, in
said City.
The City Clerk is hor_ eby dir eted to provieie all supplies
that may be neoessary to properly and lawfully condilat said
special election.

YMen the poi:} ks are closed the officers of the Otection
shall count the ballots cast at such special election and canvass
the votes cast respectively for and against tape proposition herein
stated and make retimn thereof to the Mayor and Common Council
of the City of Gilroy in the time, form and manner required for
the counting, canvassing and returning of votes cast at other
Municipal elections held in the City of Gilroy.
Sectian 5.
This Ordinance shall be published once each week for
two sumcessive weeks prior to said 2,7 day of May 1913, in
the Gilroy Gazette, which is a newspaper of general circulation,
printed and published less than six days a week in said City of
Gilroy, and this Ordinance and quoh publioation shall be the
notice of said election.

This ordinance shall take effect and be in force im--
med,iat ely.
