AN ORDINANCE GRANTING UNTO THE SOUTHERN PACIFIC 00MPANY,
ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO LAY A TRACK ACROSS
THE LEAVESLEY ROAD IN THE CITY OF GILROY,
The Mayor and Coimnon Council of the City of Gilroy do
ordain as follows:—
Section I.
There is hereby granted unto the Southern Pacific
Railroad Compaxnr, its successors and assigns, the right to
construct and maintain and operate by steam or other lawful
motive poser, a single track of railroad across the Leavesley
road in the City of Gilroy subject to the ordinances of the
City of Gilroy, and the conditions of Section ? of this Ordi-
nance hereinafter contained., said track to be on the Southern
Pacific Railroad right of rMy, and is to cross the Leavesley
Road between the Hain track of the Southern Pacific Railroad
Company and the spur track leading to the property of the
Standard oil Company
Section. ;II.
The right and privileges hereby granted ?into the
Southern Pacific Railroad Company shall always be subject to
the right of the City of Gilroy to said Leavesley Road for a
public Street and highway, and the right of the City to lay
pipes in said roadway, for Mater, gas, sewer or other p1zrposes,
and the right to lay or authori?.e the laying, of electric wires
for any purpose under the surface of said street or roadway.
The said railroad company shall at all times keep and main-

said road and shall at all times keep said track at the crossing
of said roadway in a good condition, and so that it can be
easily and comfortably crossed. by F.ragons and other vehicles,
and the ground between the rails of said track shah be covered
pith asphalt, broken rock or some other suitable substance.
section III.
This Ordinance shall take effect and be in force from
and after its paseage and approval.
