AN ORDINANCE CREATING A BOARD OF FORESTRY FOR THE CITY
OF GILROY, AND PRESCRIBING THE DUTIES OF SUCH BOARD, AND ALSO
PROVIDING FOR THE PROTECTION AND PRESERVATION OF TREES UPON
THE STREETS AND SIDEWALKS OF THE CITY OF GILROY,
The Mayor and CommonnCouncil of the City of Gilroy do
ordain as follows:—
I.
A Board of Forestry is hereby established to consist of
three competent persons, who shall serve without compensation,
and who shall hold office for a term of three years from and
after the date of their appoifitment, and until their successors
are appointed, provided however, that the persons first appointed
shall so classify themselves by lot that one of their number
shall retire on the first Monday of June 1915, one member thereof
on the first Monday of June 19169 and one member thereof on the
first Monday of June 1917.
The members of the Board shall be appointed by the Mayor,
with the approval of the Common Council, and in case of a
vacancy in an unexpired term, the appo �ntee to fill the same
shall hold for the unexpired term of his prOdeoessor.
II.
The Board of Forestry shall have power to decide all things
relative to planting trees upon the streets and sidewalks of
the City of Gilroy, and to determine all questions respecting
the planting, cutting, care of, and removal of such trees.

The owner of any lot or land on the side of the street or
sidewalk in front of which any tree is growing, or to grow, or
hereafter planted, or any citizen of the City of Gilroy taking
exception to the decision of the Board of Forestry, or feeling
aggrieved at its action, may appeal to the Mayor and Common
Council from such decision or action for relief or redress, and
the action of the Mayor and Common Council therein shall be final.
III.
It shall be unlawful for any person to mar, deface, cot
or in any manner to injure or damage any tree now growing, or
hereafter planted on any street or sidewalk within the limits
of the City of Gilroy without having first obtained the written
consent of the Board of Forestry of the City of Gilroy, or the
consent of the Mayor and Common Council of the City of Gilroy,
in case of an appeal having been taken from the decision or
action of the Board pf Forestry.
Before the Board of Forestry shall consent to the cutting
of any tree, or any part thereof, the Board must be satisfied
that the owner of the lot or land on the side of the street
immediately in front of which such tree is growing has received
notice of the intention to out such tree.
It shall be unlawful for any person to mar, deface, out
or in any manner injure or damage any tree growing on private
property within the limits of the City of Gilroy without the
consent of the owner thereof.
IV.
Iny person violating or wilfully non- oomplying with any
of the provisions of this ordinance is guilty of a misdemeanor,
and shall, upon oonvietion thereof, be punished by a fine not
exceeding One hundred Dollars, or by imprisonment in the City
Prison not exceeding thirty days, or by Moth such fine and
imprisonment,
V.
This Ordinanoe shall take effeot and be in foroe from and
after its passage and approval.
