ORDINANCE NO. 295.

AN ORDINANCE REQUIRING ALL PERSONS APPEARING UPON TH~ PUB-
LIC STREETS, PUBLIC PLACES, OR IN ANY ASSEMBLAGE OF PERSONS !
TO WEAR A MASK OR COVERING OVER THE NOSE AND MOUTH, DURING
THE PERIOD OF THE EPIUEKIC ltNOWN AS THE "SPANISH INFLUENZA,"
AND PROVIDING A ~NALTY FOR THE VIOLATION HEREOF,
THE MAYOR AND CO~fON COUNCIL of the City of Gilroy do ordain
as rollows:
SECTION 1. During the period or the epidemic of the so-called
"Spanish Influenza," which is now prevalent in the City of Gilroy,
which for the purpose of,rthis ordinance shall be deemed to exist
until proclamation, provided for in section 2 of \his ordinance,
shall have been issued, every person appearing on the public
streets, or in any public place or place or business, or in any
assemblage of persons or in any place where two or more persons
are congregated, except in private offices or homes where only
members of the family are present, and every person engaged in

the sale. handling or distribution of foodstuffs or wearing ap-
parel, shall wear a mask or covering, except when partaking of
meals, over the nose and mouth consisting of four-ply material
known as butter cloth or of fine mesh gauze, at the four corners
of which are attached tape or other fastening, so that the mask
or covering can be madeto firmly cover the nose arid mouth, said
mask to be not less than rive inches in width and seven in
length.
SECTION %. When the Board of Health shall determine that the
~7?~sald epidemic of Spanish influenza has ceased to exist in the City
~ of Gilroy said board shall communicate its determ~nation to the

Mayor of the City of Gilroy, who thereupon shall issue a proclam-
ation to the people of the City of Gilroy proclaiming the fact
that the Board of Health haa determined that said epidemic has
ceased to exist.
SECTION 3. Every person who shall violate any of the provis-
ions of section 1 of this ordinance shall be deemed guilty of a
misdemeanor and shall be punished by a fine of not less than five
($5.) dollars or more than ene hundred ($100.) dollars, or by
imprisonment "in the city jail for a period not exceeding ten da.s,
or by both such fine and imprisonment.
SECTION 4. This ordinance shall be in force and take effect
immediately after its passace and shall remain in force and effeet
until" the date of said proclamation provided for in section 2
hereof.
Adopted and passed this 25th day of October, 191R, by the fol-
lowing vote:
