Section 1. at Article II Ch II 1't III of the Municipal Co m w f4 y o'i '#iJ roy be, and the IkM to hereby amended to read f ins° it+ollows: — ARTICLE II. CLASSIFICATION OF BUSINESS AND CHARGES FOR LICENSES. Section 310. The classification of business, other than li'QUor business, and the charges for licenses to be paid in the City of Gilroy shall be as provided for in this Article, and for the ge of conducting, operating or carrying; on, within thR the Gity of Gilroy, any business, profession, trade off'` hereinafter in any subdivision of this Section enumerated, the person, firm or corporation so engaged shall pay the license fee hereinafter in the following subdivisions of this Section provided : - AGENTS AND BROKERS. 1. For the business of buying, selling or renting real estate c� WN "S► agent or as factor of another, or for conducting a general real estate business in the City of Gilroy, the sum of Three Dollars per f- quarter. For the business of buying or selling hay, grain, fruit, or other-farm produce of any kind, or conducting a warehouse, grist mill, or flour mill, or for keeping any place of storage for any such farm produce as agent or factor for another, or for the account of any person, firm,or corporation so buying, selling, grinding, or storing the same, the sum of Five Dollars per quarter. AUCTIONEERS. 2. For selling real and personal property at public outcry the sum of Two Dollars per day, or Seven Dollars per quarter. AUT1011OBILE AGENTS. 3. Every person, firm or corporation engaged in the business of selling automobiles, tractors and motor vehicles in the City of Gilroy, as agent for another or otherwise, and having no fixed place of besiness, shall pay a license fee of Ten Dollars per quarter. BILLIARD AND POOL TABLES. 4. For each Billiard Table and Pool Table and Bowling Alley kept for hire the sum of.Two and one -half Dollars per quarter. BILL POSTERS. S.For posting bills and maintaining bill boards and advertiz- ing sign boards for which a charge is made for displaying a sign. or Advertisement, within the City of Gilroy, the sum of Five Dollars per quarter. BARBER SHOPS A14D IUMCURE PARLORS. 6. livery person firm or corporation engaged in the -2- business of conducting a barber shop or manicure and hairdressing parlor in the City of Gilroy shall pay a license of One and one- half Dollars per quarter. BLACKSMITH AND MACHINTE SHOPS. 7. Every person, firm or corporation engaged in the business of conducting a Blacksmith shop, machine shop, or horse - shoeing shop in the City of Gilroy, at which place no machinery or implements are sold, except such as are manufactures in such blacksmith or machine shop, shall pay a license of One and one. Cj half Doll' ars per quarter. CIRCUSES AND I&NAGERIES. 81 For any exhibition for pay of any circus, equestrian, or acrobatics performance 'Twenty -five Dollars, in advance. For each caravan, menagerie, or collection of animals, for each show for pay Five Dollars in advance. For each show for any figures, gugglers, magicians, wire or rope dancing, or freaks, or any side show accompanying any circus or menagerie Three Dollars in advance. CYCLERIES AND MOTOR CYCLE SHOPS. 9. For the business of keeping a cyclery or Motorcycle shop in the City of Gilroy, where bicycles and IyIotor cycles are kept for rent or_,,hire, and for sale, and where bicycles and motor cycles are repaired, the sum of Ten Dollars per year. CREAILER I ES . Z�. Every person, firm or corporation engaged in the business of conducting and operating a creamery in the City of Gilroy shall pay a license of Three Dollars per quarter. �- CONTRACTORS. 11. Every person, firm or corporation engaged as a contractor in the construction of buildings, moving of houses, and doing cement work by contract in the City of Gilroy shall pay a license of One and one -half Dollars per quarter. DOCTORS, LA1IMRS AND DE14TISTS. 12. Every person engaged in the practice of Medicine, r Osteopathy, law or;..dentistry in the City of Gilroy shall pay a license fee of One and one -half Dollars per quarter. FISH AIM POULTRY. 13. For the business of selling fish, game or poultry, not including fresh or cured meats of other kinds, the sum of Two and one -half Dollars per quarter. GARAGES.. 14. Every person, firm or corporation keeping or operating any garage for profit, where automobiles are cleaned, stored or repaired, and where no merchandise is sold s74all pay a license of Two and one- half.•uollars per quarter. GASOLIM, AND OILS. 15. Every person, firm or corporation engaged in the business of selling gasoline and oil products in the City of Gilroy in both wholesale and retail gmantities shall pay a license of Six Dollars per quarter. HAY AIM FLED YARDS 16. For the business of keeping a hay and feed yard, barn corral, shed, or other building for the sale of any animals, hay, wood rain other g or produce, or for feeding animals of other persons at such place of business, the sum of Ten Dollars per year. HORSE TRADERS Every person engaged in the business of buying, selling and dealing in horses and mules in the City of Gilroy shall t pay a license of Two Dollars per quarter, -4r. HUTELS, BOARDING AND LODGING HOUSES. 18. For the business of keeping a public hotel, boarding house, or lodging house in the city of Gilroy the slam of Two and one -half Dollars per quarter. JOB PRINTING. 14. Every person, firm or corporation engaged in the business of job work printing shall pay a license of Two Dollars per quarter. LAUNDRIES. 20. For each laundry or wash house, or other place of business in the City of Gilroy, where washing, ironing, cleaning or drying of any clothing is done for the public, the sum of Ten Dollars per year. For eadh person, firm or corporation soliciting business , for the laundering or cleaning of any clothing, or maintaining an agency for such business in the City of Gilroy and having its place of business elsewhere than in the City of Gilroy,the sum of Ten Dollars per quarter, payable in advance.x' LIVERY STABLES, 21. For the business of keeping a livery stable, or any place where horses and horse drawn vehicles are kept for hire and sale, the sum of Ten Dollars per year. MERRY GO ROUNDS. 22. For running or conducting flying horses, so called, or merry go rounds, or any mechanical swing, car, or other such device, Five Dollars per day. 15 'D IC IRE VET3DO RS . 23. For every patent medicine vendor using music or other means to attract crowds or fornthe sale of patent medicine by 0 any other method than at a fixed and permanent place of business, _5_ such as a drug store, an apothecary shop, the sum of Fifty Dollars per quarter. For every traveling exhibition employing devices as telescopes, microscopes, lung testors, muscle testors, ball, knife, or ring throwing, and all devices similar in character not otherwise spe©ia11y licensed the sum of Five Dollars per week. 'DIUVI_ OR, CLAT.RvOYZT. 24. Every person who carries on the business of a MediUM or clairvoyatt, in the City of Gilroy shall pay a license of Ten Dollars per quarter. MARBLE AND MONUMENTS. 25. Every person, firm or corporation engaged in the business of making and selling monuments, and cutting marble and stone in the City of Gilroy shall pay a license of One and one -half Dollars per quarter. IV= WAGONS. 26. Every person, firm or corporation engaged in the business of delivering milk from any wagon or auto vehicle in the City of Gilroy shall pay a license of Two and one -half Dollars per quarter. IMRSERIES. 27. For the business of conducting a nursery in the City// of Gilroy, and for the busin"'� of selling trees, plants and shrubs in the City of Gilroy as agent or factor for any nursery outside of the City of Gilroy, the sum of Twenty Dollars per year. PEDDLERS. 28. For the business of soliciting or canvassing for the sale of books, maps or pictures the sum of Five Dollars per month., For the peddling of grain, hay, farm products, vegetables, meats,(fi'h, poultry, eggs, butter and cheese, not the produce 6 of the person vending the saite, the sum of Two and one -half Dollars per quarter. For the,hawking or itinerant vending of dry goods, groceriesip hardware, jweelry, or any other goods, wares or merchandise or commodities, not otherwise provided for in this section, or for canvassing or soliciting for the sale of the same, with or without samples, the sum of Five Dollars per day, or if paid for one month, the sum of Fifteen Dollars per month, fully paid in advance, pro- vided that nothing herein contained shall be deemed to apply to the employee of any established business house of the City of Gilroy, canvassing or soliciting sales for their goods, or to canvassers or solicitors of established wholesale dealers who shall canvass or solicit orders from established dealers only. PAVIR BROKERS. 29. For the business of a rawnbroker, or keeper of a pawn broker shop the sum of Five Dollars per quarter. PUBLIC VEHICLES ADD JOB WAGONS. 30. For the business of keeping an omnibus, stage coach, hack, cob, carriage,!,: automobile or other wheeled vehicle for public use for the transportation or conveyance of passengers for hire within the City of Gilroy, the sum of Three Dollars per quarter for each such vehicle. For the business of keeping a dray, cart, wagon or other vehicle for public use in hauling or transporting arW goods, wares � `- commodities or other things from one place to tunother within the City of Gilroy, by the load or job for hire, for each team of one or two animals, or each motor vehicle, the sum of Three Dollars per quarter. PHOTO GRArHERS. 31. Every person, firm or corporation engaged in the business -7- J of conducting a Photograph gallery at a fixed place of busines$ in the City of Gilroy, shall pay a license of One and one -half Dollars per quarter, and every person taking photographs for pay without any fixed place of business in the City of Gilroy, shall Pay a license of Five Dollars per quarter. RESTAURANTS AND LUNCH COUNTERS. 32. For the business of keeping a restaurant, chop - house, eating house, or any other stand, booth, or place for the sale of coffee, oysters, or other refreshments or food, the sum of Two and one -half Dollars per quarter. SHOOTING GALLERIES. 33. For the business of keeping; a pistol, rifle or shooting gallery of any kind the sum of Ten Dollars per quarter. SXATTNG RINKS., 34. Por the business of keeping and running a public skating rink the sum of Twenty Dollars per year. SIGN PAINTERS. 35. Every person engaged as a sign painter in the City of Gilroy shall pay a license fee of One and one -half Dollars per day, or rive Dollars per year. SOLICITING FOR PRINTING. 36. Every person soliciting for printing; in the City of Gilroy and having no permanent place of business in the City of Gilroy shall pay a license of Five Dollars per day. For each theatrical performance „ opera, moving pircture show, coneert,exhibition given by minstrels, panorama, magic lantern or scenic entertainment, skating, dancing or ballet, and shows of any kind not hereinbefQre mentioned, for the first per- formance, Three Dollars -ind for each subsequent performance when -8� a series of exhibitions are given on consecutive days by the same party or parties, the sum of Two Dollars; provided that the proprietor or lessor of any theatre, hall, moving picture house, or place where such performances or exhibitions are given may secure an annual license for such place of entertainment which shall be Twenty Dollars per year, in advance. ORDER FOR CLOTHING. 39. Every person engaged in soliciting orders for clothing and having no parmanent place of business in the City of Gilroy shall pay a license of Ten Dollars per day, or of Thirty Dollars per month. UNDERTAKERS . 40. Every person, firm or corporation engaged in the undertaking business in the City of Gilroy, whether in connection with any other business or not, shall pay a license of Five Dollars per quarter. The provisions of Section 313 shall not apply to this subdivision. VULCANIZING. 41. Every person, firm or corporation engaged in the business of vulcanizing in the City of Gilroy, in connection wrath which said business no merchandise is sold, shall pay a license of One and one -half Dollars per quarter. Section 311. All persons, firms or corporations engaged in the business of selling at wholesale or retail, except as in the Code otherwise provided for, at any fixed place of business, within the City of Gilroy, any goods, wares, groceries, jewelry, books, stationery, drugs, medicines, cured or fresh meats, furniture, ironware, hardware, farming machinery and implements, ice, lumber, drygoods, clothing, boots and shoes, harness and leather -ware, millinery goods, musical instruments and supplies, ice cream and candies, cigars and tobacco, and any and all other articles of merchandise not otherwise in this Code provided for, shall pay a quarterly license as follows:- V-v"hen the gross receipts from all sales, plus the commission on goods sold on commission, does not exceed the sum &f :5000. per year, a license of Two and one -half Dollars per quarter; When the gross receipts from all sales, plus the commission on goods sold on commission, exceeds the sum of :5000. and does not exceed the sum of :10000, per year, a license of Four Dollars per quarter; When the goods receipts from all sales, plus the commission on goods sold on commission, exceeds the sum of X10000. per year, and does not exceed the sum of X20000. per year, a kicense of Six Dollars per quarter; When the gross receipts from all sales, plus the commission on goods sold on commission, exceeds the sum of 420000. per year and does not exceed the sum of 430000. per year, a license of .fight Dollars per quarter. When the gross receipts from all sales, plus the commissions on goods sold on commission, exceeds the sum of V30000. per year and does not exceed the sum of 440000. per year, a license of Ten Dollars per quarter; When the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of 040000. per year, and does not exceed the sun of 450000. per year, a license ,10.- of Twelve and one -half Dollars per quarter. When the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of POOOO. per year, sand does not exceed the sum of 460000. per year, a license of Fifteen Dollars per quarter; When the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of X60000. per year and does not exceed the sum of X70000. per year, a license of Seventeen and one -half Dollars per quarter; When the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of X70000. per year, and does not exceed the sum of 8OOOO. per year, a license of Twenty Dollars per quarter. When the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of X50000. per year and does not exceed the sum of 490000. per year, a license of Twenty -two and one -half Dollars per quarter. Vhen the gross receipts from all sales, plus the commission on all goods sold on commission, exceeds the sum of 490000. per year, the sum of 'iwenty -five Dollars per quarter. Section 312: On or before the 10th day of January of each year, every person, firm or corporation in the City of Gilroy conducting any business mentioned in Section 311 for which no other license tax is provided, in this Code shall make and file with the Clerk of the City of Gilroy, a sworn statement in such form as may be required by him showing the gross amount of all sales made during the preceeding twelve months, on account of said business, together with a statement of the t6tal amount of corrjission and percentage received on account of goods sold on consignment or _11� as agent for another, and the amount of the license tax for the calendar year beginning January first shall be based on the amount of business done during the preceeding year as shown by said sworn statement. +Then a person, firm or corporation has not been in business during the whole of the preceeding year, the amount; of the average monthly sales and commissions for the time he has been in business multiplied by twelve will be the estimated amount of the gross receipts of Bald and commissions from said business for a year, and the license tax shall be based thereon. The license tax of a person, firm or corporation about to commence any business mentioned in this Section who has not been engaged in said business in the Sity of Gilroy at uiy time during the preceeding calendar year shall be determined as follows; - At the time of applying for a license said person, firm or cor )oration shall make and file in the office of the Clerk of the City of Gilroy a sworn statement of the inventoried value of the stock he will carry in trade, including all machinery and equip- ment, fixtures and furniture to be used in connection with said business, and the license tax for the unexpired part of said calendar year shall be payable as gollows: - If the inventoried value of the etock to be carried plus the value of the machinery and equipment, fixtures and furniture, does not exceed the sum of 415000. Two and one- half-Dollars per quarter If the inventoried value of the stock to be carried in trade plus the value of the machinery and equipment, fixtures and furniture, exceeds the sum of X5000. and does not exceed the sum of 010000. Four Dollars per quarter. If the inventoried value of the stock to be carried in trade plus the value of the machinery and equipment, fixtures and -12- furniture exceeds the sum of 410000. and does not exceed the sum of .'20000.,3ix Dollars per quarter. If the inventoried value of the stock to be carried in trade, plus'the value of the machinery and equipment, fixtures and furniture, exceeds the sum of 9-20000. and does not exceed the sum of 430000., Eight Dollars per quarter. If the inventoried value of the stock to be carried in trade, plus the value of the machinery and equipment, fixtures and furniture, exceeds the sum of 9'30000. and does not exceed the sum of '9-40000.., Ten Dollars per quarter. If the inventoried value of the stock to be carried in trade plus the value of the machinery and equipment, fixtures and fur- niture, exceeds the sum of j40000. and does not exceed the sum of 9-50000. , Twelve and or. p_half Dollars per quarter. If the inventoried value of the stock to be carried in trade plus the value of the machinery and equipment, fixtures and fur- nitre, exceeds the sum of 9-50000. and does not exceed the sum of X60000., Fifteen Dollars per quarter. If the inventoried value of the stock to be carried in trade, plus the value of the machinery and equipment, fixtures and furniture, exceeds the sum of :60000, and does not exceed the sum of 9-70000., Seventeen and one -half Dollars per quarter. If the inventoried value of the stock to be carried in trade, plus the value of the machinery and equipment, fixtures and furniture, exceeds the sum of 470000. and does not exceed the sum of 9-80000., Twenty Dollars per quarter. If the inventoried value of the stock to be carried in trade, plus the machinery and equipment, fixtures and furniture, exceeds the sum of 9-80000., and does not exceed the sum of 490000. Twenty -two and one -half Dollars per quarter. -13- If the inventoried value of the stock to be carried, plus the value of the machinery and equipment, fixtures and furniture, exceeds the sum of 490000., Twenty -five Dollars per quarter. Upon the failure or refusal of any person, firm or corpora- tion to furnish the City Clerk with the statement herein provided for promptly and upon demand, the City Clerk may:.fix the license under any classification provided for in Section 311, which in the judgment of the Clerk is a proper license for such person, firm or corporation. Section 313: In case of a person, form or corporation doing a business specially mentioned in any subdivision of Section 310, in conjunction with the sale of any goods, wares and merchandise mentioned in Section.311,1sueh pervon, fiat or c&rporation shall pay but one license, which license shall be under the Section which shall yield to the City of Gilroy the greatest amount of revenue from said business. Section 314: All quarterly licenses in this article provided for shall be due and payable on the first day of January, April, July and October of each year, and all yearly licenses provided for shall be due and payable on the first day of January of each year, provided that every person, firm or corporation now doing business in the City of Gilroy under a license from the City of Gilroy shall continue doing business under said license until the expiration of the period for which said license is paid, without change. Any person, firm -..or corporation applying for a license to conduct any business in the City of Gilroy for which a license is required during any quarterly period, or yearly period, shall -14- LI pay therefor the pro rata which the unexpired part of the license perioears to the whole license period. 6ECTiON 2. All Ordinan ees of the City of Gilroy and sections of the Municipal Code of the City of Gilroy in conflict herewith are hereby repealed. 06 Section 3. This Ordinance shall take effect and be in force from and after its passage and approval.
