AN ORDINANCE REGULATING TRAFFIC AND THE CARE OF VEHICLES,
AND ANIMALS ON AND OVER THE PUBLIC STREETS OF THE CITY OF GILROY,
PRESCRIBING A PENALTY FOR THE VIOLATION OF ANY PROVISION HEREOF,
.AND REPEALING OnnINANCE .0. 291 AND ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH.

The Mayor and Common Council o~ the City o~ Gilroy do
ordain as rollows:-
Section 1. For the purpose of' this Ordinance the ~ellow-
iBg words and terms shall be held to include and have the follow-
ing meanings, viz:
The word "street" shall mean and be held to include every
avenue,highway, roadway, lane or alley in the City of' Gilroy,
under the jurisdiction of' said City.
The word fteurb" shall mean the lateral boundary o~ that
portigD of' a street designated ~or the use of Tehicles, whether
marked by a curbing constructed or stone, concrete or other
material, or not so marked.
The word-.vehicle" shall mean and include every wagon, bug-
gy, carriage, bus, push cart, bicycle, tricycle, automobile, motor-
cycle, or other conveyanoe, except baby carriages, children's tri-
cycles and invalid chairs, in whatever manner or by whatever
~orce or power the same may be driven, ridden or propelled, which
is or may be used fo'r or adopted to pleasure :t;"iding, travelling
or the transportation of passengers, baggage, merchandise or freight
upon any street, all f'arm machinery propelled over a $treet by
force, and every draf't or riding animal, whether riddeB er led, or
standing still, provi(ing, however, that an ~al or an~als
attached to any vehicle shall with such vehicle, constitute one

The word "driver" shall mean and include every rider or
driver of an animal, the rider of a bicycle or tricycle, the

operator of a motor vehicle, and the person in charge or control
of any animal, bicycle, trioycle, motor vehicle or push cart on
any street.
The work "animal" shall include every horse,' d.onkey, mule
or other an1mal used ~or motive power ror any vehicle.
The word.s "business district" include that portion o~
Monterey Street in the City of Gilroy which lies South of the
south line of Third Street and North p~ the north line o~
l EiJ!:tih Street.
The, words tt sa~ety zone" shall mean that space marked by

white, painted lines and marked "Safety Zone" at street inter-
sections and street crossings set apart for the safety of'
pedestrians crossing the street.
Section 2. The driver of any vehicle in or upon any
street shall drive such vehicle upon such street in a careful
manner and with due regard for the safety and convenience of
pedestrians and all other vehicles upon such street.
Section 3. The driver of' any vehicle upon meeting any
other vehicle at any place upon any street shall turn to the right
and on all occasions shall travel on the right hand side of the
street, and on the right hand side of the white painted line in
the center of' the street, and as near the right hand curb thereof as
is possible when other vehicles are on the street.
Section 4. The driver of any vehicle shall, in overtaking
and passing any other vehicle in or upon any street, pass to the
le~t of such vehicle and shall not again drive to the right until
clear of such vehicle, and the driver of such vehicle being over-
taken and passed, shall give way to the right.
Section 5. The driver of any vehicle moving showly in, along
or upon any street, shall keep such vehicle as close as possible

to the curb on the right allowing more swi~tly moving vehicles
free passage to the le~t.
Section 6. The driver of any vehicle in or upon any
street shall, in turning to the right into another street, turn the
corner as near tbe right hand curb as possible.
Section 7. The driver of any vehicle in or upon any street
shall, in turning to the left into another street, pass to the right
of, and beyond the center of the street intersection be~ore turning.
Section 8. The driver of any vehicle crossing from one
side of the street to the other side thereof, shall make such cross-
ing by turning to the left so as to head in the direction in which
the traffic is moving on the side of the street toward which said
crossing is made. In the business district, such crossing is to be
made only at street intersections. Every vehicle must be on the
right hand side of the street and on the right hand side of the white
painted line i~ the center of the street at all times, and at street
intersections and street crossings, pass to the right of the space
marked "safety zone". No vehicle Shall stand on any street within
fifteen ~eet of any fire hydrant. or within ~ifteen feet of the curb
line of any intersecting street.
Section 9. Except as hereinafter provided in Section 10
of this Ordinance, no vehicle shall be allowed to stand or be parked
in any part of the business district of the City of Gilroy as defined in
this Ordinance, between the Southerly line of Third Street and the
i Northerly line of S~y~n!h Street, except it be allowed to stand or
be parked at an angle of 45 degrees to the curb and with the right
front wheel at the curb, AND THEN ONLY IN THE SPACE OR STALL MA.RKED
AND SET ASIDE FOR PARKING PURPOSES, which space or stall shall be
indicated by means of white painted lines on the pavement. Parking
of automobiles at any place in said business district between the
southerly line of Third Street and the Northerly line of S!!~~h
Street other than in the spaces marked and set aside ~or parking
shall be unlawful.

Section 10. Jlo vehicle shall be left 'backed up to the
curb of any street except while such vehicle is being actually
loaded or unloaded, and in case of a vehicle drawn by an animal or
antmals, only when the .animal or animals are swung around in the
cii.rection in which the traffic is mo'd.Dg, 011 the side of' the street
on which the vehicle is stancliJJg.
Section 11. The driver of any vehicle shall immediately
before stopping or altering his course of travel, indicate his
purpose by giving a signal with his hand to the driver of other
vehicles on the street.
Section 12. Jlo person under the age o~ sixteen years shall
be allowed to run or drive any automobile or locomobile on any
street o~ the City of' Gilroy.
Section 13. Bo person shall ride or attempt to ride on
the rear end of any vehicle or attach any vehicle thereto on any
street of the City of Gilroy, without the permission of the driver
of' such vehicle.
Section 14. Jlo vehicle used for the purpose of vending
merchandise, mea~s, fruit, vegetables or contectionery, or vehicles
commonly known as peddlers' carts or wagons, shall be allowed to
stand on any street in the City of Gilroy tor a period of' more
than fifteen minutes at a time, except by permission of' the Mayor
and Common Council, provided this section shall not apply to vehicles
used for the delivery of goods my merchants having fixed places of'
business in Gilroy.
Section 15. No vehicle used ~or the transportation o~
crude oil or any of' its products in tanks shall be allowed :tn or upon
any street of the City of' Gil~oy unless such vehicle is provided
with drip pans or other devise to prevent leakage of' the contents
of' the tanks upon the street, and such tanks must in all cases be so
arranged and handled that no leakage of any kind can occur.

Section 16. No vehicle used for the purpose of carrying
sand, gravel, earth, rock or other loose or liquid substance
liable to si~t or spill out, shall be allowed on any paved street
of the City of Gilroy, unless the same is made tight and so con-
structed as to prevent the sifting or spilling e~ any of its
contents upon the street over which it passes.
Section 17. No traction engine or other vehicle having
upon its wheels any block, stud, cleat, ridge, head or any other
proturberance of metal which projects more than one-quarter o~
an inch beyond the tread or traction surface of the tire, or on
jhe track upon which it runs, or which shall make a mark or cut
one-quarter of an inch deep in any pavement, shall be permitted
on any paved street of the City of Gilroy.
Section 18. When any vehicle shall be loaded in such a
manner that any portion of the material constituting the load
shall project or extend six feet or more behind the rear end of
the body of such vehicle, or shall extend a distance of eighteen
inches beyo~ the side of the body o~ such vehicle, a red flag
shall be carried by day and a red light by night and securely
fastened in a conspicuous position at the extreme rear end of such
load and at the point where said load shall extend the greatest dis-
tance beyond the sides of said vehicle.
Section 19. It shall be unla~ul to park any automobile,
auto truck or trailer in any public alley way in the City of Gil-
roy, and no auto truck ob trailer shall be permitted to be parked
on any public street in front o~ any property not owned or con-
trolled by the owner or operator of such auto truck or trailer, Tor
a period longer than one hour. A.uto trucks and trailers may be
parked on the side of the street on Monterey Street at any point more
than ~ifteen feet north of the northerly line of Third Street or at
any point more than fifteen feet south of the southerly line of

Seventh Street for a period not to exceed one hour, provided such
parking does not interfere with the driveway or entrance to any
private property.
Section 20. IDmlediately after the passage and adoption of
this Ordinance, it shall be the duty of the City Marshal and the
Chairman of the Street Oommittee of the Oommon Oouncil to cause the
pavement on Monterey Street between the Southerly line of Third
Street and the Northerly line of Depot Avenue to be marked with
white painted lines designating the center line of the street, the
street corssings ~or pedestrians, the safety zones at street cross-
ings and intersections and the spaces or stalls set aSide for
par~ing purposes.
(Section 21. This Ordinance is intended to co-operate and
harmGnize with the laws of the State of California relative to
the use and operation of vehicles upon the public highways of the
State of Cali~orni~, and in addition thereto to provide further
rules and regulations for the operation of vehicles in the City
of Gilroy, and all laws of the State of California relative to
the use and operation of vehicles upon the public highways of the
State of California shall apply to the operation of vehicles upon
the streets of the City of Gilroy. In case of con~lict between
this Ordinance and any law of the State of california, relative to
the use and operation of vehicles upon the public highways, the laws
of the State of California shall prevail.
~ Section 22. Any person violating or wilfully non-complying
with any of the provisions of this Ordinance shall be guilty of
a misdemeanor and shall, upon conviction thereof, be punished by
fine not exceeding One Hundred DOllars, or by imprisonment in the
City Prison not exceeding thirty (30) days, or by both fine and
imprisonment.
. Section 23. All Ordilllaaces and parts of Ordinances in con-

flict with any provision of this Ordinance are he~eby repealed.
Section 24. This Ordinance shall take effect and be in
force on and after ~~ .__ days after its passage and approval.
