ITS LESSEES, SUCCESSORS AND ASSIGNS, THE FRANCHISE, RIGHT AlfD PRIVILEGE TO CONSTRUCT, I,IAIlfTAIN AND OPERATE RAILROAD TRACKS AND APPU}~'r.~~TANCES UPON iLi'ID ACROSS CERTAIN STREETS IN THE CITY OF GILROY IN THE LOCATIONS HER~IN.~ DESCRIBED: The Common Council of the City of Gilroy do ordain as follows: 1. There is hereby granted unto the Southern Pacific Railroad Company, a corporation, its lessees, successors and assigns, the right, privilege and franchise to construct, reconstruct,maintain and operate railroad tracks of standard gauge and to pass with and operate locomotives propelled by steam, electricity or any other lawful motive power, and to run trains and cars thereon and thereover and to carry freight and passen- gars for hire, upon and over said railroad tracks, together with the neces- sary appurtenances, appendages, mechanical appliances and equipment for the same in, upon and across those certain streets in said City of Gilroy, hereinafter referred to, and in the locations more particularly described as follows, to-wit: OLD GILROY STRTmT, C.R.C. ~-ao.7: Center line description of tracks to be constructed: Beginning at a point in the southerly line of Old Gilroy street distant 22 feet measured at right angles to and northeasterly from the center line of the present main line track of the Southern Pacific Railroad Company; thence northwesterly across Old Gilroy Street parallel to and at a uniform distance of 22 feet northeasterly from the said oenter line of the present main line traok a distance of 80 feet more or less to a point in the northerly line of Old Gilroy street. Beginning at a point in the southerly line of Old Gilroy street distant 37 feet measured at right angles to and northeasterly fram the oenter line of the pre..at main line track of the Southern Pacific Railroad Company; thence northwesterly across Old Gilroy Street parallel to and at a uniform distance of 37 feet northeasterly from the said center line of the present main line traok a distance of 80 feet more or less to a point in the northerly line of Old Gilroy street. lrINTH STREET, C. C. 1lB-80. 8 : Center line description of tracks to be constructed: Beginning at a'point in the southeasterly line of Ninth street distant thereon 22 feet northeasterly from the center line of the present main line track of the Southern Pacific Railroad Company; thence northwesterly across Ninth Street parallel to and at a uniform distance of 22 feet northeasterly from the said center line of the present main line track a distance of 60 feet more or less to a point in the northwesterly line of Ninth Street. -1- ~ Beginning at a point in the southeasterly line of Ninth Street distant thereon 37 feet northeasterly from the center line of the present main line track of the Southern Pacific Railroad Company; thence northwesterly across Ninth street parallel to and at a uniform distance of 37 feet northeasterly from the said center line of the present main line track a distance of 60 feet more or less to a point in the northwesterly line of Ninth street. 2. The right, privilege and franchise hereby granted shall always be subject to the ordinances of the City of Gilroy and the right of the City of Gilroy to use said streets hereinabove referred to for public street and highway purposes and the right of the said City to lay pipes in the said streets for water, gas, sewer or other purposes and the right to lay or authorize the laying of electric wires for any purpose under the surface of said streets. 3. The grantee, its lessees, suooessors and assigns, shall at all times keep and maintain the said tracks acrose said streets at the same grade as the surface of the said streets, and flush with the sur- faoe thereof, and shall construct and maintain the portion of said streets between the rails of said tracks and for a distance of two (2) feet outside of said rails in accordance with the specifications and standards pre- scribed by the Railroad Commission of the state of California. 4. This ordinance shall take effect and be in force from and after its passage and approval. 5. The Grantee shall replace the street area torn up in conneotion with the work of removal of existing tracks at the street crossings above ref:erredto with paving or other material similar to the pavement or other material now in said s~reets.
