RESOLUTION NO. 1199
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
PROVIDING THAT NO OBJECTIONS HAVE BEEN MADE TO
THE DEMOLISHING AND REMOVAL OF THE DWELLING FOR-
MERLy LOCATED AT AND KNOWN AS NO. 126 SOUTH
CHURCH STREET IR GILROY, CALIFORNIA, AFTER NOTICE
DULY GIVEN AND 'rHAT THE COST OF SUCH DEMOLITION
AND REMOVAL SHALL BE CHARGED TO THE OWNERS OF THE
PROPERTY AS A SPECIAL ASSESSMENT ON THE lAND ON
WHICH THE BUILDING WAS LOCATED AND THAT THE SAME
SHALL BE COLLECTED IN THE MANNER AS A SPECIAL AS-
SESSMENT.
WHEREAS, the Council of the City of Gilroy has heretofore
ordered the demolition and removal of the building formerly used
as a dwelling located at No. 126 South Church Street, more parti-
cularly described in "Exhibit A" attached hereto and made a part
hereof, because said building constituted a fire hazard; and
WHEREAS, notices were duly given to the owners of said prop-
erty of the order to remove said building in accordance with Section
203 of the Uniform Building Code, 1961 Edition, heretofore adopted
as the Building Code of the City of Gilroy, by personal service and
to all others by publication as required by the order of the Council;
and
WHEREAS, the Council did on the 18th day of December, 1967
adopt Resolution No. 1197 in which the cost of the demolitbn and
removal of said building was fixed at the sum of $950.00 plus $28.88
cost of publication of Notice and fixing January 2, 1968, at the hour
of 8:00 PM., the the Council Chambers in the City Hall at No. 10
South Rosanna Street, Gilroy, California as the time and place for
hearing objections to said cost and the proceedings for assessing
the cost against the said land, as described in said Resolution No.
1197 and notice of said hearing was given as ordered in said Resolu-
tion, and said hearing has been held and no one appearing to object
to the said cost or proceedings.

NOW, THEREFORE, in accordance with said Resolution No. 1197,
it is hereby resolved and ordered that the said sum of $950.00 the
cost of said demolition and removal of said building was and is
reasonable and proper; that due notice of the proceedings for charg-
ing said cost against said premises as a special assessment have
been given and that the said cost of $950.0~and the cost of publi-
cation of notices herein amounting to $28.88/ amounting in all to
the sum of $978.88, shall constitute a lien against the land herein-
before mentioned until paid and shall be collected with other taxes
assessed against the property in the same manner as general City
.taxes and shall be subject to the same penalties and interest and
the same procedure and sale in case of delinquencies as provided for
City taxes; and
BE IT FURTHER ORDERED that a certified copy of this Resolution
be delivered to the officers performing the duties of assessor and
tax collector for the City of Gilroy to the end that said costs be
assessed as hereinabove provided.

lowing vote:

All that certain real property situate in the City
of Gilroy, County of Santa Clara, State of Calif-
ornia, described as follows:
PORTION OF LOT 9, in Block 2, South Range 2 West
as shown upon Map No.5, accompanying report of
the Commissioner's in Henry Mi ller et al, Plain-
tiffs vs. Massey Thomas et al, Defendants, in the
Superior Court of the State of California, in and
for the County of Santa Clara, Case Number 5536,
and more particularly described as follows:
BEGINNING at a point on the Northeasterly line of
Church distant thereon 151.25 feet Southeasterly
from the point of intersection of the said North-
easterly line of Church Street with the Southeasterly
line of Seventh Street, as said Streets are shown
upon the Map above referred to, said point of begin-
ning also being the Southernmost corner of that cer-
tain parcel of land described in the Deed from Laura
A. Green to Albert Sgheiza, dated January 23, 1936
and recorded February 5, 1936 in Book 758 O. R.,
page 302, Santa Clara County Records; then leaving
said last named line and running Northeasterly and
along the Southeasterly line of the land so des-
cribed in the Deed to said Albert Sgheiza, 140 feet
to the Easternmost corner thereof on the Southwest-
erly line of an alley; running thence Southeasterly
and along the Southwesterly line of said alley, 63.75
feet to the dividing line between Lots 9 and 10, in
Block 2, South Range 2 West, as said alley, lots,
block and range are shown upon the Map above refer-
red to; running thence Southwesterly and along said
last named dividing line 140 feet to the said North-
easterly line of Church Street; running thence North-
westerly and along the said Northeasterly line of
Church Street 63.75 feet to the point of beginning.
