Resolution 779 RESOLUTION NO, 779 RESOLUTION OF THE CITY OF GILROY CON- SENTING TO THE RELINQUISHMENT OF A CERTAIN CITY STREET AS A COUNTY HIGH- WAY FOR CONSTRUCTION UNDER THE 1961 COUNTY HIGHWAY BOND PROGRAM WHEREAS, the Board of Supervisors of the County of Santa Clara adopted a resolution on August 12, 1963 determining that Leavesley Road between Monterey Road and Gilroy City limits be established as a county highway, and requesting the City of Gilroy to consent to the relinquishment of such street to the county as a county highway within the City of Gilroy. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy, acting pursuant to the authority of Article 5 (commencing with section 1720), Chapter 9, Division 2, of the Streets & Highways Code, that the City of Gilroy does hereby consent to relinquish to the County of Santa Clara, Leavesley Road, as it now exists within the city limits of the City of Gilroy, from Monterey Road to the city limits of the City of Gilroy. BE IT FURTHER RESOLVED that the City of Gilroy does hereby consent to relinquish that portion of Leavesley Road hereinabove described to the County of Santa Clara as a county road with the understanding that the County of Santa Clara will undertake to widen said portion of Leavesley Road to a four-lane divided high- way and construct drainage improvements within the right of way of said road, said widening and drainage improvement costs to be paid out of the 1961 County Highway Bond funds allocated for expenditure within the City of Gilroy, and out of State Urban Extension Funds allocated to the project. BE IT FURTHER RESOLVED, that the City of Gilroy shall maintain ve-described portion of Leavesley Road until such time as the I: /; (j construction of the aforesaid improvements is commenced by the County of Santa Clara. BE IT FURTHER RESOLVED, that the Clerk of the City of Gilroy is hereby directed to file two certified copies of this resolution with the Board of Supervisors of the County of Santa Clara. Monterey Road and 537 feet East of Gilroy city limits be improved as a part of plan for construction of county roads in the so-called Hnon- expressway cities" (as that term is defined in the Expressway Policy Resolution of the Board of Supervisors dated December 27. 1960).
