Resolution 1979- 12 .- -' . . ~ RESOLUTION NO. 79-12 RESOLUTIONCF THE CITY OF GILROY APPROVING A PO PLANNED UNIT DEVELOP1ENT PERMIT, SUBJECT TO COMPLIANCE WITH THE PLANS, SPECI~ICATIONS AND DESIGNS FILED WITH THE APPLICATION AND TO BE FI ~ED AND APPROVED, AND THE CONDITIONS IMPOSED HEREIN, FOR JEVELOPMENT OF THAT 10.7 ACRE PARCEL LOCATED ON THE EAST SIDS OF WREN AVENUE OPPOSITE MONTE BELLO DRIVE. WHEREAS, FILLCE ESTATE VINEYARDS has heretofore filed with the Planning Commissi)n of the City of Gilroy application Z 79-2 requesting approval of a Plalned Unit Development permit for P.O. (Professional Office) developmelt of 10.7 acres of property located on the east side of Wren Avenue opposite Montebel1o Drive, and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a p\lblic hearing upon the said application. in accordance with the Zoning Ordinance of the City of Gilroy. has held the hearing, has approved a Ne~ ative Declaration under the California Environmental Quality Act and h, s made its report to the Council of the City of Gilroy, in which t recommends approval of a P.O. planned unit develop- ment permit, subjtct to certain conditions, and WHEREAS, the Council of the City of Gilroy has fixed the 5th day of March, 1979, at the hour of 8:00 0'c1ock p.m. in the Council Chambers in the C:ty Hall at 7390 Rosanna Street, Gilroy, California, as the time and pJace for hearing the said report and recommendation upon the said app:ication, and notice of the said hearing has been given in accordanle with the said Zoning Ordinance, and a public hearing has now been held upon the said application. at the time and place fixed in the said notice. before the Council. and the Council having duly considered tle said application and the evidence presented. the Council does herel,y determine: 1. That the Council approves the Negative Declaration under the California Enviro:~ental Quality Act. RESOLUTION NO. 79. 12 . . ff' 2. The! t the Council approves and adopts the findings of the Planning COLmission set forth in its Resolution No. 79-9. 3. That Planned Unit Development permit be granted subject to the conditions set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY that a Planned Unit Development permit be granted for the premises describec below. subject to the following conditions: (1) (2) (3) (4) (5) (6) That th€ Planned Unit Development permit be issued for PO development, subject to the condition that all improvements are to be constructed in accordance with plans, specifications, designs, and landscaping filed with and approved by the Planning Commission and the Councilor no building permit be issued. The lot split shall be processed prior to issuance of building permits. Architectural and Site approval shall be required of Phase 3 to assure compatibility of all phases. Complete landscape plans, including fencing and wall plans, s:lall be submitted for Architectural and Site review and approval. The entrance and exit drive shall be fully developed in Phase 1. A second access shall be provided for Phase 1 until all Phases are complete. The east side of Wren Avenue, curb, gutter and pavement, shall be completed from First to Third Streets with Phase l. BE IT FURTHER P~SOLVED that upon completion of all phases of (7) construction, the entire premises be rezoned P.O. as developed. The said premises hereinbefore mentioned are described as follows: Located in the City of Gilroy, County of Santa Clara, State of California, to wit: East side of Wren Avenue opposite Montebello Drive also shown as Parcel 808-08-003 in the -2- RESOLUTION NO. 79-~ . . -' Santa Clara County Tax Assessor's Map Book, containing 10.7 acres.
