Resolution 1979- 39A ;;:. . . ~ r RESOLUTION NO. 79-39A A RESOLUTION PROVIDING FOR THE ALTERAT10NS OF THE BOUNDARIES OF THE CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "PACHECO PASS HH~HW1\Y ANNEXATION 79-2 TO THE CITY OF GILROY" ~llliREAS, a written petition has been filed in the office of the City Clerk of the City of Gilroy in accordance with the provisions of the "Hunicipa1 OrFanization Act (,f 1977", asking that there be annexed to the City of Gilroy certain uninhabited territory located in the County of Santa Clara, State of California, hereinafter more particularly described; and mrnr~AS, said petition has been signed and consented to by the owners of all of the land in the territory proposed to be annexed and said territory is contiguous to the City of Gilroy; and ~mEREAS, an application for annexation of the said premises has been filed vlith the Santa Clara County Local Agency Formation Commission, and said Commission did make its determination upon the proposed annexation and has approved and authorized said annexation as proposed pursuant to section 35157 of the Government Code; and WHEREAS, pursuant to Section 35151 of the Government Code the territory is to be annexed without notice and hearing, and without an election. NOW, TIIEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY AS FOLLOWS: Section I: Under the authority of the said "Municipal Organization Act of 1977", and Section 35221 of the Government Code of the State of California, there is hereby annexed to the City of Gilroy, the uninhabited territory particularly described as follows: All the real property situated in the County of Santa Clara, State of (:a::"ifornia, described as follows: B(.gj nning at the southeasterly corner of Pacheco Pass Highway No. 77-7 Annexation to the City of Gilroy, Northeasterly 650 feet more or Jess to the Southwesterly corner of Pacheco Pass Higbway N(,. 75-2 Annexation; thence along the Southwesterly line of thp laRt sAid Annexation, Northwesterly 1341 feet more or less !.{, thE' intersection thereof with the SoutheLLv Right of Way liLP c,f ;>dcheco Pass Hif'hwaYi thence along the last said RESOUJTITLi :W. /9-:~9A , -j- .. . . ,. line, Northwesterly 709 feet more or less a:.d 120 feet more or less to the Intersection with the Northeasterly line of Pacheco Pass Hi.ghway No. 70-6 Annexation; thence along the Northeasterly line of Pacheco Pass Highway No. 70-6 and No. 77-7 Annexations, Southeasterly 1936 fe(~t more or less to the point of beginning. Containing 25 Acres more or less. vb/ I) Section II: The said territory hereby anne:>:ed to the City of Gilroy is hereby designated as "PACHECO PASS HIGHWAY ANNEXATION 79-2 TO THE CITY OF GILROY". Section III: This annexation shall take effect on the date of the recordation of a certified copy of the certificate of completion with the county recorder pursuant to Section 35354 of the Government Code.
