Resolution 1979- 51 --= " ,,\ . . .. -...... ,~ RESOLUTION NO. 79-5l RESOLUTION OF TIill COUNCIL OF THE CITY OF GILROY DENYING THE APPLICATION OF HARRY AND IffiRNINIA OKADA TO REZOHE A PARCEL ON THE EAST SIDE OF EIGLEBERRY STREET APPROXIMATELY 161 FEET SOUTH OF NINTH STREET FROM R3 DISTRICT TO R3X DISTRICT. WIlli IffiAS, application Z 79-10 has heretofore been made by lIAPJRY ArID HERMINIA OKADA to the Planning Commission of the City of Gilroy for a rezoning a parcel on the east side of Eigleberry Street approxi- mately 161 feet south of Ninth Street from R3 District to R3X District, and 'WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application. in accordance with the Zoning Ordinance of the City of Gilroy. has held the hearing, and has made its report to the Council of the City of Gilroy; in which it reconunended that rezoning be granted; and \lliEREAS, the Council of the City of Gilroy fixed the 2nd day of July, 1979, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy. California. as the time and place for hearing the said report 'and recommendation uuon the said application, and notice of the said hearing has been given iu accordance with the said Zoning Ordinance, and a public hearing has now been held upon the application, at the time and place fixed in the said notice, before the Council, and the Council having duly considered the said application and the evidence presented, and having determined that the application for rezoning should be denied in accordance with the following findings: 1. The proposed zoning would create spot zones, and 2. General Plan revisions should be completed before this propused rezoning is decided. -1- REqOLUTION NO. 79-51 ~ . . , . . ," NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy does hereby reject findings of the Planning Comrnission and does hereby determine that the said application for rezoning be and the smne is hereby denied without prejudice.
