RESOLUTION NO. 86-21
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING NUMERICAL
LIMITS FOR RESIDENTIAL DWELLING UNITS TO BE ISSUED BUILDING PERMITS
FOR EACH OF THE YEARS 1987, 1988 and 1989.
WHEREAS, pursuant to the City of Gilroy Residential
Development Ordinance, once each year, the City Council of the
City of Gilroy shall determine the maximum number of dwelling
units to be issued building permits; and
WHEREAS, the City Council of the City of Gilroy
desires to encourage a rate of growth which will not exceed the
City's ability to provide adequate and efficient public services
of the ability of the local economy to support such growth, the
Council desires to maintain and improve the quality of the
environment and preserve the City's natural setting, desires to
provide and maintain a balanced community with adequate housing
to meet the needs of local employment and residents, and desires
to provide and maintain a sound economic base for the City; and
WHEREAS, pursuant to Section 5 of the City of Gilroy
Residential Development Ordinance, the City Council of the
City of Gilroy has fixed the 7th day of April 1986, at the
hour of 8:00 o'clock p.m. in the Council Chambers in the City
Hall at 7351 Rosanna Street, Gilroy, California as the time and
place for considering and adopting the said Numerical Limits
for each of the years 1987, 1988 and 1989, and notice of
said hearing has been given in accordance with said Ordinance,
and a public hearing has now been held upon the said Numerical
Limits, at the time and place fixed in the said notice, before

the Council, and the Council having duly considered studies

and testimony relevant to the residential development program,
and having determined that the Numerical Limits should be
set with the following findings:
1. The City's ability to provide additional
sewage treatment services is severely impaired,
and the timing of the resolution of this
problem is uncertain.
2. When the 1988, 1989, and 1990 numerical limits
are considered in April 1987, the Council will
have a much greater understanding of the City's
ability to allocate sewage capacity. The
1988 and 1989 numerical limits can be increased
at that time.
3. A large number of previously-committed build-out
assignments are still pending, with some degree
of uncertainty as to the timing of build-outs.
Projects which have already been approved and
which have demonstrated a desire and capability
to build within approved build-out periods
should receive priority for remaining sewage
capacity.
4. Additional personnel and equipment will be
required to meet the demands of increased
growth. Eliminating the 1986 competition will
allow the City time to meet the needs for services
already required by previously approved projects.
5. Since the annual competition involves the
expenditure funds and fees by the applicants and
administrative costs by the City, a competition
for a small number of units in 1986 is not warranted.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Gilroy that in accord with the City of Gilroy
Residential Development Ordinance, the Council hereby establishes
that:
1. None be the maximum number of dwelling units
issued building permits for 1987, in accordance
with the Residential Development Ordinance.

2. None be the maximum number of dwelling units
issued building permits for 1988, in
accordance with the Residential Development
Ordinance.
3. None be the maximum number of dwelling units
issued building permits for 1989, in
accordance with the Residential Development
Ordinance.
PASSED AND ADOPTED this 7th day of April 1986,
by the following vote:
