RESOLUTION No. 87 - 7
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY OF AGREEMENT WITH ENERGY MANAGEMENT
SERVICES AND THE CALIFORNIA ENERGY COMMISSION CONCERNING THE PARTICIPATION OF THE
CITIES OF GILROY AND MORGAN HILL IN THE ENERGY MANAGER SALARY GUARANTEE PROJECT.
WHEREAS, the Cities of Gilroy and Morgan Hill desire to reduce their
energy costs and consumption in government operations; and
WHEREAS, such reduction in energy costs is heavily dependent upon having
a staff member responsible for implementing the programs necessary to make such
reductions; and
WHEREAS, Energy Management Services (herein "EMS"), through its Energy
Manager Salary Guarnatee Project, as funded by the California Energy Commission
(herein "CEC"), is guaranteeing that the first year of such an Energy Manager's
salary will be less than the annual dollar savings due to installing energy
conservation measures or EMS will reimburse the City for any shortfall, subject to
the conditions contained in the letter of agreement.
NOW, THEREFORE, BE IT RESOLVED that the City of Gilroy agrees to
participate in the Energy Manager Salary Guarantee Project and agrees to abide by
the conditions contained in the letter of agreement between EMS, CEC and the Cities
of Gilroy and Morgan Hill with such letter of agreement containing such features
as:
1. Responsibilities of Gilroy and Morgan Hill:
a. Hire/assign qualified staff to act as Energy Manager by March I,
1987;
b. Arrange for utility-conducted energy audits on all Gilroy and
Morgan Hill facilities;
c. Maintain an energy accounting system to track monthly utility
bills through at least April 1, 1988;
d. Develop an energy management program for Gilroy and Morgan Hill
operations;
e. Review and implement, prior to November I, 1987, cost-effective
energy management recommendations identified through the program
as having an economic payback of three years or less;
f. Provide regular reports on the progress towards achievement of
energy cost savings goals;

2. EMS responsibilities:
a. Guarantee that the annual gross dollar savings, calculated
pursuant to the letter of agreement, will be greater than or
equal to the first year salary of an Energy Manager;
b. Provide assistance in the design and implementation of the local
program;
c. Provide training of the new Energy Manager;
d. Provide technical assistance in the areas of energy accounting,
energy audit analysis, installation of energy savings devices,
project financing, and preparation of grant, loan and incentive
program applications.
3. CEC responsibilities:
a. Monitor the progress of the Salary Guarantee Project through its
contract with EMS.
The foregoing resolution was read at a regular meeting of the City
Council of the City of Gilroy on the 17th day of February, 1987, and was Passed and
Adopted by the following vote:
