RESOLUTION NO. 95-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING THE RESIDENTIAL DEVELOPMENT
ORDINANCE PROJECT RATING SCALE PURSUANT TO
ZONING ORDINANCE SECTION 50.65
WHEREAS, Section 50.65 of Zoning Ordinance of the City
of Gilroy provides that the City Council may from time to time
adopt a Project Rating Scale for use by the Planning commission in
its competitive evaluation and ranking of projects subject to the
Residential Development Ordinance; and
WHEREAS, at its duly noticed and regularly held meeting
of May 4, 1995, the Planning commission recommended certain changes
in that Project Rating Scale dated 9/20/93; and
WHEREAS, at its duly noticed and regularly held meeting
of May 15, 1995, the city Council reviewed the staff report and all
written and oral testimony.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of
the City of Gilroy hereby adopts the following amendments to said
project Rating Scale:
1. The introductory paragraph shall read as follows:
The city Council shall examine each proposed development and shall
rate each development, in relation to the other projects proposed,
by the assignment of no more than the maximum number of points
allowable in each category. Projects shall first be evaluated and
assigned points according to categories I, II, III, then evaluated
again under categories I, II, III, & IV, of the following rating
scale.
This will create two separate rankings from which the
Planning commission and the City Council may select projects to be
assigned build-out schedules.
2. Paragraph III. DESIGN, A. preserving site Features,
shall read as follows:

Conformance of the site Design to the natural topography,
maximizing open spaces and preserving resources such as existing
housing units, water recharge areas, and prime agricultural lands,
etc. Zero to six points should be given to projects which will
negatively impact site features; six points should be given to
projects which will not impact site features; and 6 to 12 points
should be given to projects which will preserve and enhance site
features.
3. sections A., C., E., and F. of paragraph IV. COMMUNITY
BENEFIT FACTORS shall read as follows:
A. Cultural and Recreational Benefits
provision of new facilities, such as theaters, cultural
centers and community recreation centers, or other improvements for
cultural or community benefit. Points shall be determined based
on the project's community benefit in proportion to the number of
units in each project.
C. School Facilities - On-Site
provision of land and/or buildings on the site, in proportion
to the total land area of the project, for school facilities beyond
what is required by law.
E. Capital Improvement Benefits
provision of public works or capital improvements beyond what
is normally required which will serve the site as public benefits
such as developed public parks and waterways, bikeways, bridges,
ptililic access roads, etc., based proportionally on the nunber of
units in each project.
F. Preservation and Dedication of Open space
Provision of land, in proportion to the total land area of
the project, to be kept in permanent open space as a recreational

or aesthetic benefit for the community.
PASSED AND ADOPTED this 26th day of June, 1995 by the
following vote:

VALDEZ, GAGE.
NOES: COUNCILMEMBERS: GILROY.
ABSENT: COUNCILMEMBERS: NONE.
