Resolution 1997-23 . . ,. RESOLUTION NO. 97-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DENYING VARIANCE V-96-11, AFFIRMING THE PLANNING COMMISSION'S DENIAL OF VARIANCE V-96-11, AND DENYING THE APPEAL OF THE PLANNING COMMISSION'S DECISION ON VARIANCE V- 96-11 (APN 790-42-072) WHEREAS, Richard Davis ("Applicant") submitted a request for approval of Variance V-96-11 to allow a Recreational Vehicle (RV) port within the required street side yard setback on property located at the northwest corner of Hoesch Way and Culp Drive (APN 790-42-072); and WHEREAS, the Planning Commission at its duly noticed public hearing on March 6, 1997 reviewed the Applicant's request for Variance V-96-11 and after considering all of the evidence before it determined that all of the findings outlined in Zoning Ordinance Section 50.21 (c) required for variance approval could not be made and denied the request; and WHEREAS, the Applicant appealed the Planning Commission's decision to the City Council; and WHEREAS, on April 21, 1997 and April 28, 1997 the City Council held duly noticed public hearings to consider Applicant's appeal, and after considering all of the evidence before it the City Council determined there were not facts to support the findings required by Zoning Ordinance Section 50.21(c) for approval of the variance. NOW, THEREFORE, BE IT RESOLVED THAT: 1) Variance V-96-11 should be and hereby is denied. 2) The Planning Commission's determination to deny Variance V-96- 11 should be and hereby is affirmed. 3) The Applicant's appeal of the Planning Commission'S determination to deny Variance V-96-11 should be and hereby is IKBAI339756,01 71-043004706002 -1- RESOLUTION NO. 97-23 . . ;y denied.
