RESOLUTION NO. 2000-79
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING THE CITY OF GILROY MASTER
PLAN OF FIRE SERVICES.
WHEREAS, from October 1999 until July 2000, the City of Gilroy ("City") conducted a
series of meetings of a fifteen (15) member Gilroy Fire Services Master Plan Task Force
("Task Force") to work with the City's selected consultants, Citygate Associates, to study fire
services programs and policies; and
WHEREAS, the work of the Task Force culminated in a "Master Plan of Fire Services"
including sixteen (16) findings and recommendations published for consideration and adoption
by the City; and
WHEREAS, the City has undertaken an Initial Study and Preliminary Mitigated Negative
Declaration on the Master Plan of Fire Services and developed a Mitigation Monitoring Program,
the comment period for which ended on October 29, 2000; and
WHEREAS, the Task Force together with the City's Fire Chief and Facilities and Parks
Development Manager requested the City Council to adopt the Master Plan as set forth in that
document entitled "Master Plan of Fire Services and Final Report" dated August 2000 and
published by Citygate Associates, hereafter referred to as the "Master Plan of Fire Services", and
attached hereto and incorporated herein as Exhibit A; and
WHEREAS, the City Council, after a public hearing held November 20, 2000, adopted
the Mitigated Negative Declaration, attached hereto and incorporated herein as Exhibit B,
finding that (a) it was completed in compliance with CEQA, (b) it reflects the independent
judgment of the City, and (c) there is no substantial evidence that the project will have a
significant effect on the environment; and
WHEREAS, thereafter the City Council considered the Master Plan of Fire Services.
NOW, THEREFORE, BE IT RESOLVED THAT:
A, The City Council hereby adopts the Mitigation Monitoring Program for the
Master Plan of Fire Services, attached hereto and incorporated herein by this
reference as Exhibit C,
B, The City Council hereby adopts the Master Plan of Fire Services.

further excavation or disturbance of the site or any nearby area
reasonably suspected to overlie adjacent human remains until thp
coroner of Santa Clara County is contacted to detmninc that
investigation of the cause of death is required. If the coroner determines
the remains to be native American, the coroner shall c:ontact the Native
American Hc:ritagc Commission within 24 hours. The Native American
Heritage Commission shall identify the person or persons it believes to
the most likc:ly descendent (MLD) from the deceased Native American.
The MLD may then' make Rcommendations to the landowner or the

development of a new fire station is on the list,

Mitigation Measnre No. 10 The City of Gilroy shall conduct a site-specific initial study that includes an
analysis of flooding and flood flows in the project vicinity for any site it
selects for development of a new fire station.
Mitigation Measure No. 11 The City of Gilroy shall conduct a site-specific initial study that includes an
analysis ofland use compatibility for any site selected within an area zoned
for residential use.
Mitigation Measun: No. 1% The City of Gilroy shall conduct a site-specific initial study that includes an
analysis of !!oise for any site it selects fur development of a new fire station.

Mitigation Monitoring Program
Introduction
On January 1, 1989, the California State Legislature passed into law Assembly Bill 3180, This bill
requires public agencies to adopt reporting or monitoring programs when they approve projects
subject to an environmental impact report or a negative declaration that includes mitigation measures
to avoid significant adverse environmental effects, The reporting or monitoring program is to be
designed to ensure compliance with conditions of project approval during project implementation in
order to avoid significant adverse environmental effects,
The law was passed in response to historic non-implementation of mitigation measures presented in
environmental documents and subsequently adopted as conditions of project approval, In addition,
monitoring ensures that mitigation measures are implemented and thereby provides a mechanism to
evaluate the eff,;ctiveness of the mitigation measures.
A definitive set of project conditions would include enough detailed information and enforcement
procedures to ensure the measure's compliance. This monitoring program is designed to provide a
mechanism to ensure that mitigation measures and subsequent conditions of project approval are
implemented,
Monitoring Program
The basis for this monitoring program is the mitigation measures included in the initial study. These
mitigation measures are designed to eliminate or reduce significant adverse environmental effects to
less,than-significant levels, These mitigation measures become conditions of project approval, which
the City of Gilroy is required to complete during and after implementation of the proposed project.
The attached checklist is proposed for monitoring the implementation of the mitigation measures.
This monitoring checklist contains all appropriate mitigation measures in this initial study.
Monitoring Program Procedures
It is required that the City of Gilroy use the attached monitoring checklist for the proposed project.
The morutoring program should be implemented as follows:
1. The Gilrov Plarming Director should be responsible for coordination of the monitoring
program, including the monitoring checklist. The Plarming Director should be responsible
for completing the monitoring checklist and distnbuti.m; the checklist to the responsible
individuals or agencies for their use in monitoring the mitigation measures,
2. Each responsible individual or agency will then be responsible for determining whether the
mitigation measures contained in the monitoring checklist have been complied with, Once
all mitigation measures have been complied with, the responsible individual or agency
should submit a copy of the monitoring checklist to the Plarming Director to be placed in the
project file. If the mitigation measure has not been complied with, the monitoring checklist
should not be returned to the Planning Director.
3. The Planning Director will review the checklist to ensure that appropriate mitigation
measures and additional conditions of project approval included in the monitoring checklist
have been complied with at the appropriate time, e.g. prior to tentative map approval, prior
to issuance of a building permit, etc, Compliance with mitigation measures is required for
project approvals,
4, If a responsible individual or agency determines that a non-compliance has occurred, a
written notice should be delivered by certified mail to the City of Gilroy within 10 days
describing the non-compliance and requiring compliance within a specified period of time,
The City of Gilroy will bring the project into compliance,

for development of a new fire station. If the analysis concludes that the City's
existing storm drain system is not adequate, appropriate improvements shall
be ineo orated into the project,

landowner or his authorized representative mects the ,
recommendation of the MLD, and the mediation by
the Native American Heritage Commission fails to
provide measures acceptable to the landowner.
13, The following language shall be included on any City of Gilroy City of
permits issued at the project site, subject to the Gilroy
review and approval of the City of Gilroy
Engineering Division,
All construction activities shall be limited to
weekdays between 7:00 AM and 7:00 PM, and to
Saturdilys and City holidilys between 9:00 AM and
7:00 PM, No construction is allowed on Sundays.
In addition, temporary benns or noise attenuation
barriers shall be utilized when necessan{.
