Resolution 2005-90RESOLUTION NO. 2005 -90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY, ADOPTING THE 2005 URBAN WATER MANAGEMENT PLAN WHEREAS, the Urban Water Management Planning Act, commencing with Section 10610 of the California Water Code, requires every urban water supplier to adopt an urban water management plans; and WHEREAS, Section 10621 of the California Water Code requires the water supplier to review and update its urban water management plan at least every five (5) years on or before December 31, in years ending with five (5) and zero (0); and and WHEREAS, the City of Gilroy ( "City ") has prepared an Urban Water Management Plan; WHEREAS, the City has reviewed and updated that plan and completed the 2005 Urban Water Management Plan document; and WHEREAS, the City Council held a public hearing on December 5, 2005, at which time the City Council considered the public testimony, Staff's Memorandum to Council dated November 9, 2005, and all other documentation related to the 2005 Urban Water Management Plan; and WHEREAS, in accordance with California Water Code Section 10642 and California Government Code Section 6066, at least 14 days' notice of the time and place of said public hearing was given by publication in a newspaper twice at least five (5) days apart, throughout which notice time the 2005 Urban Water Management Plan document was made available for public inspection; and RESOLUTION NO. 2005-90 -1- WHEREAS, the preparation and adoption of urban water management plans and updates thereof are exempt from review under the California Environmental Quality Act (CEQA) pursuant to California Water Code Section 10652 and CEQA Guidelines Section 15282(s); and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy approves and adopts the 2005 Urban Water Management Plan.
