Sec 1. 1\?o person or persons sl 'all Here-
after put np'or erect any chimney or flue
within the - corporate limits ,ofthe Town of
Gilroy, made of any combustible material ;
nor shall anv stove or, grate, within the
said limits, be placed nearer than twenty -
,four inches to any board or canvass wall or
partitiop, unless such board or canvass
wall be protected by some metalic or fire -
prosif material; and in all buildings having
wooden floors, such floors shall be protect-
ed from heat by as metalic plate or brick
pavement, projecting at loast eight inches
around the stove or grate.
See. 2. No person or persons shall erect
or put up any flue or stove pipe, within
said limits in said town, f'or conducting
smoke so as to have the same project or
pass through any partition wall, ceiling or
roof, unless the aperture in such.partitimn,
ceiling or roof, through which suvh.flue or
stove pipe passes, have " a thimble " or
plate with hole, said stove pipe to be at
least four inches each way from the wood,
and said thimble or plate to be securely
fastened and broad and substantial enough
to protect such partition, ceiling or roof
from fire ; and no flue or stove pipe shall
pass through any window -sash or glass on
any side of any building or in any partition
wall in any building within said limiti.-
Every such pipe shall extend above the ap-
erture, in the outside roof, through which
the same passes, to the distance of at least
five feet, and shall be securely jointed and
wired down or otherwise fastened to the
roof, so as to prevent its being blown down j
or nfr by the wind.
See. 3. No person, residing within the
said limits in said Town, shall place or
su�fer to be placed any hot ashes or embers
within ton feet of any building, unless se-
curely covered in some non - combustible
receptacle.
See. 4. Any"person guilty of a violation
of either of the foregoing sections, shall,
upon complaint of any resident of said
Town, and upon conviction before the Re
corder or any Justice of the Peace in said
Town, be flned in a sum not less than five
nor more than fifty dollars, and in default
of payment of such fine, shall be imprisoned
In the county jail at the rate of one day for
every two dollars of the fine imposed.
See. G, There is hereby established in
the Town of Gilroy a Board of Fire Com
missioners, to consist of three .persons,
one of whom shall be a member of the
Board of Town Trustees, the three to be
appointed by voteof the Board, whose duty
it shall be' to make diligent examination at
least once every thirty days of all the
houses and buildings within said limits in
said Town, and they are hereby authorized
And empowered to do $a, and to see that;#,11-
of the stoves, chimneys; flues, stovepipes,
&c., ure erected or put up in conformity
to the requirewents of this or4ivance,,k1W
to see and report to the Board of Trustees,
all violations thereof.
Sec. 6. It is further made the duty of
every person owning or occupying any
house, building or room in said limits of`
said Town, iininediately tm arrange, erect
or put up all flues, or stove pipes; novv ,iii!.
such building, houses or rooms, but'riot
erected or put up in conformity to the
provisions ofthis ordinance, so as to make'
such flues or stove pipps conform . ur all
respects yviththe requirementeof this or-
dinance; and if any person, so owning or
occupying any building, house or room
within said limits shall, upon notiee`from
said Commissioners, refuse or tail to make
leis or her flue or stove pipe conform in all
lrespects with the provisions of this crdin
ante, within three days of being so notifxod,-
he or she shall be fined, or filed and im-
prisoned.as above in this ordinance provi-
ded.
This ordinance shall be in force fiop-
sand after its passage.
