AMENDING ORDINANCE NO. 427 REGULATING AND CONTROLLING DOGS,
PROVIDING FOR THEIR LICENSES, REPEALING SECTIONS 167, 168, 169. 170,
and 171 OF THE MUNICIPAL CODE OF THE CITY OF GILROY AS AMENDED BY
ORDINANCES NUMBF1tED 263, 370 and 406, REGULATING A!\TD CONTROLLING DOGS
AND PROVIDING FOR THEIR LICENSES BY PROHIBITING DOGS FROM BEING OR
RUNNING AT LARGE WITHIN THE CITY OF GILROY.
THE COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLm'lS:
SECTION 1. Section 2 of Ordinance No. 427 of the City of Gilroy
is hereby amended to read as follows:
It shall be unlawful for any person, firm or corporation to allow
or permit any dog belonging to, possessed by, or under the control of
such person, firm or corporation, to run at large in or on any street,
alley, sidewalk, vacant lot, public square or other public place, or in
or upon any private property or premises other than those of the person,
firm or corporation having charge, custody or possession of such dog
within the City of Gilroy unless such dog be restrained by a substantial
leash not to exceed six (6) feet in length and is under the immediate
care, control, oustody and possession of a competent person.
SECTION 2. Section 13 of said Ordinance No. 427 of the City of
Gilroy is hereby amended to read as follows:
It shall be the duty of the City Marshal and the duty of every
Policeman and/or any Poundmaster appointed by the City of Gilroy to
take into custody and impound all dogs found or running at large in any
street, alley, public square, vacant lot, sidewalk or other uninclosed
place within the City of Gilroy in violation of this Ordinance, and also
to take up and impound all dogs found within said City which are not
provided with or wearing tags as herein provided, and place such dog or
dogs in the City Pound, and when so impounded they shall be kept securely
for forty-eight (48) hours. If not claimed and redeemed before the ex-
piration of such time, they shall be killed and buried by the officer
impounding them. Any dog so impounded may be redeemed by the owner or
person entitled to its possession within forty-eight (48) hours after
impounding, upon presenting a license tag and the payment to the Pound
Master of the sum of One ($1.00) Dollar for impounding the dog and the sum
of T\venty-five cents (25~) per day for feeding said dog during the time
impounded.
SECTION l. This ordinance shall be in full rorce and effect from
and after its passage and approval.
