THE COI~uN COUNCIL OF THE CITY OF GILROY JOES URDAIN AS FOLLOWS:
SECTI0N I: That the ~ommon Council of the City of Gilroy hereby
determines to provide for the assessment of property for municipal taxes
and for the equalization and correction thereof, for the collection and
enforcement of the payment of such taxes, for the sale anp redemption from
sale of property sold for non-payment of such taxes, by officers of Santa
Clara County and for the performance by Off~ ers of said County of the
duties of officers of the City of Gilroy respecting sam matters, pursuant
to and in accordance with the provisions of the act of the Legislature of
the state of California, entitled "An act to provide for the levy and
collecticn of taxes by and for the use of municipal corpor~tions and
cities incorporated under the laws of the state of California, except
municipal corporations of the first class, and to provide for the consolld~
ation and abolition of certain municipal offices, and to provide that their
duties may be performed by certain officers of the county, and fixing the
compensation to be allowed for such county officers for the services so
rendered to such municipal corporationsott (Statso 1895, p. 219 as amended
by the Stats. 190;, p. ~29, stats. 1913, p. ~~1, and subsequent aaend-
ments.)
SECTION II: That, beginning with the tax year 1952, and until
. further ordered by the Common Council, the duties of the following

referred to, to-wit:
(~) The City Assessor's duties with respect to the assessment
of property in the City tor municipal taxes, shall be performed bY'
th~ County Assessor;
(b) The City Councilts duties with respect to the equalization
and corrections of such assessments of property in the City for .unici~a1
taxes, shall be performed by the County Board of Supervisors;
(e) The City Clerk's duties with respect to the computation
and entry ot the amount ot taxes to be paid as a tax on the property
listed on the a.sessment rOll, and the transmissions of such roll to the
Tax Collector shall be pertormed by the County Auditor;
(d) The duties of the City Marshall, as ex-officio collector
with respect to the collection, ~ayment, and enforcement of such taxes
including delinquent taxes and other redemption of such property from
sale or other penaltY' for the non-payment of Municipal taxes of said
~ City, shall be pertormed by the County Tax Co1lectoro
SECTION III: The amount ot compensation to be charged by and
paid to Santa Clara County for the pertormance of services herein
cn.temp1ated shall be fixed by agreement between the Board of Supervisors
of Santa Clara County and the Common Council of the City of Gilroy on
beha1t of the City of Gilroy; provided, however, that such compensation
shall in no event exceed one percent (1%) of the first $25,000.00 of
taxes collected, and one-fQurth of one percent of all moneys collected
in excess of $25,000.00.
SECTION IV: Tax moneys collected by the County of ' Santa Clara
ordInance
officials under the provisions of this -"r'/',;J~~l shall be drawn from the
funds belonging to the City of Gilroy in the hands of the County Treasurer
bY' warrant of the County ,luditor which shall be issued at the request
of the City Clerk-of the City of Gilroy in writing.
SECTION V: The City Clerk of the City of Gilroy is herebY'

directed to tile with the County Auditor of Santa Clara County prior to
the first Monday in FebruarY', 1952, a certified copy of this ordinance.

SECTION VI: Sections 250 to 288 inclusive and all amendments
thereto or to any or said Sections as set forth in Part 3, Chapter 1
of the Kunicipal Code of the City of Gilroy and all other ordinances
ot the City of Gilroy in conflict herewith, are hereby repealed insofar
as they relate to taxes which may be hereafter levied or assessed
against property in the City of Gilroy; provided that all taxes hereto-
fore levied pursuant to any ordinance repealed by this ordinance,
inCluding delinquent taxes, shall be collected and the payment thereof
enforced in the same manner and upon the same penalties, and property
may be sold for nonpayment thereof and may be redeemed from such sale
in the saae manner and under the same conditions as provided by the laws
and ordinances ot the City ot Gilroy in torce at the t1me ot the taking
eftect of this ordinance, and the City ofticers reterred to and described
1n the said City ordinances repealed hereby shall collect and enforce
the payment of such taxes heretotore levied, 1ncluding delinquent taxes,
and do any and all things that may be necessary in the sale at property
tor the nonpayaent ot such taxes and in the redemption thereof froa
saleo All the duties of the City Tax COllector, the City ~ssessor, and
the City Clerk, as fixed by the charter of the City ot Gilroy and/or by
Ordinance, except the duties herein specifically transterred to the
officials of the County otSanta Clara, shall continue to be pertormed by
the said City otticials.
SECTION VIla This ordinance shall take ettect and be in torce
