ORDINANCE OF THF: CITY OF GILROY ANFNDING SECTION ,131 OF
THE MUNICIPAL CODE BY ESTABLISHING THE POSITION OF SARGENT
OF THE POLICE AND FIXING THE DUTIES OF SUCH. OFFICER AND
ELIHINATING l'HE OFFICE OF CAPTAIN OF POL,ICE', AND A.MENDING
SECTION 141 OF THE MUNICIPAL CODE BY PROVIDING FOR THE DUTIES
OF SARGE11T OF POLICE,. AND AMENDING SECTION 147 OF THE
MUNICIPAL CODE RELI!;.TING TO THE RANK OF POLICE O~ICERS.
THE HAYOR AND COMMON COUNCIL OF THE CITY OF GILROY
DO ORDAIN AS FOLLOWS:
SECTION 1. Section Blof the Municipal Code of the
City of Gilroy as set forth in Ordinance No. 466 is hereby
amended to read as follows:
Sec. 131. Police Department officers.
The Peace Officers of the Police Deparment shall
consist of:
(a) The City Harshall, who shall be the Chief of
Police.
(b) Sargent of Police
(c) Traff~c Otficer
(d) Patrolman
(e) Radio operator ";'''Police Woman.
(f) Such other police officers as the Police
Commission deems necessa:t'y shall be
appointed by the COlnmon CounCil by an
order or resolution entered on,,;J:ts minutes.
(g) Such special polic,e officers as the Common
Council may deem necessary and appoint from
time to time by order or resolution entered
in its minutes.
Peace officers, except special police officers, shall
be a;ppointed for a term of one year. Their compensation shall
be be fixed by order of the Council. The term of office and
compensation of special police officers shall be fixed by the
Council at 'the time of appointment by order or resolution
entered in its minutes. Such special officers shall be other
than and in addition to special policemen who may be appointed
by the Marshal ~s provided by Section 42 of the Charter of the
City of Gilroy.

SECTION 2. Section 141 of the ~hlnicipal Code of the
City of Gilroy as set forth in Ordinance No. 466 is hereby
amended to r2ad as follows:
Sec. 141. Duties of Sargent of Police.
The Sargent of Police on duty shall in the absence of
the City Marshal or his inability to act, be deemed the
superior officer in the police department, and at such times
all other officers shall be subordinate to and under the
control and direction of the Sargent of Police on duty, and
all his lawful orders shall be promptly executed. There shall
be two Sargents of Police, one to be on duty in the daytime
or day shift, and the other in the night time or night shift,
and such Sargents of Police shall be appointed by the order
of the Common Council.
SECTION 4. Section 147 of the Municipal Code of the
City of Gilroy as set forth in Ordinance No. 466 is hereby
amended to read as follows:
Sec. 147. Rank
The police officer holding the senior appointment,
excluding Traffic officers and Radio operators, shall in the
absence of the City Marshal and Sargent of Police or their
inability to act, be deemed the superior officer in the
Department, and all other officers, whether police officers,
special officers, or special police, shall be subordinate to
and under the control and direction of the superior officer,
and all his lawful orders subject to the lawful rules and
regulations and orders of the City Marshal, shall be promptly
obeyed.
SECTION 5. All ordinances or sections or parts of
ordinances and all amendments thereto heretofore enacted, in
conflict herewith, are hereby repealed.
SECTION 7. Effective date.
