AN uRDINANCE ESTABLISHING PUBLIC OFF-STREET PARKING LOTS IN THE
CITY OF GILROY: PRESCRIBING REGlJLATIONS RELATIVE TO TRAFFIC MOVE-
MENT AND PARKING OF VEHICLES THEREIN AND PENALTIES FOR THE VIOL.A-
TIuNS OF THE PROVISIONS THEREOF.

AS FOLLOWS:
SECTION I: Public Off-Street Parking Lots.
Public off-street parking lots are hereby established
in the City of Gilroy and all the provisions of this ordinance
shall be applicable thereto. Such off-street parking lots are
those areas so designated by resolution of the Common Council of
the City of Gilroy.
SECTION 2: Method of Regulation.
The method of regulation and control of parking or
standing of vehicles in public off-street parking lots shall be
determined by the Common Council and may be by meters, attendants,
traffic officers, police officers or any other appropriate means.
SECTION j:
Rates for use of Public Off-Street Parking
Lots:
The rates to be charged for parking in public off-street
parking lots and the hours during which the rates will be effective
shall be established by resolution of the Common Council of the
City of Gilroy and shall be designated by appropriate markings
and signs. Until the rates to be charged, if any, are determined
by the Common Council, no charge shall be made for parking in
public off-street parking lots, but this provision shall not
effect or apply to penalties for the violation of the provisions
of this ordinance .or of any regulation prescribed by the Common
. Council for the use or control of off-street parking lots.

SECTION 4:; Overtime Parking.
The limit of parking time and the days and hours during
which parking time limits shall apply on public off-street parking
lots shall be established by resolution of the Common Council.
vYhen appropriate signs or markings designating such
parking time limits are in place giving notice thereof, it shall
be unlawful for the operator of any vehicle to stop, stand, or
park said vehicle on any public off-street parking lot for longer
than the permitted time.
SECTION 5: Parking within parking spaces.
Parking spaces on public off-street parking lots shall
be designated by lines or other appropriate markings. ~Vhen parking

spaces are so designated, it shall be unlawful for the operator of
any vehicle to stop, stand or park said vehicle other than in a
regularly designated parking or loading space, across any such line
or marking or in such position that said vehicle shall not be
entirely within the space so designated as a parking space. No
vehicle shall be parked, stopped, nor shall stand neither wholly
or partially in any driveway of any public off-street parking lot
or in any manner which shall obstruct or interfere with the free
movement of vehicles in such driveway or in any manner so as to
obstruct or otherwise prevent or interfere with ingress to or
egress from any regularly designated parking space.
SECTION 6:. Use of entrance and exit.
It shall be unlawful for any person to enter any public
off-street parking lot over any area or driveway or the portion
between any curb returns which is not marked with the word Ilentrance"
or otherwise indicated by arrows, signs or words that it is a
driveway or place for the entering of such parking lot.
It shall be unlawful for any person to mcv e any vehicle
from any such parking lot into any public way over any area except
an.area marked with the word Ilexit" or otherwise indicated by

arrows, signs or words that it is a driveway or place for the
leaving of such parking lot.
SECTION 7: Use of Aisles.
It ,shall be unlawful for any person to travel in the
directionropposite to that designated in one~way aisles. It
shall be unlawful for any person to travel on- the left side of
an aisle designated for two-way traffic movement
SECTION 8: Length of Vehicles.
It shall be unlawful for any person to stop, stand or
park any vehicle having an overall length in excess of 21 feet
in any public off-street parking lot.
SECTION 9: Trailers.
It shall be unlawful for any person to stop, stand
or park any house or truck trailer in any public off-street
parking lot or to drive such trailer upon said lot~
SECTION 10: Speed of Vehicles.
It shall be unlawful for any person to move any vehicle
on any publiC off-street parking lot at a speed exceeding ten (10)
miles per hour.
SECTIONll~: Citations.
For any violation of any provision of this ordinance,
the Police Department of the City of Gilroy is hereby empowered
to issue notices to appear or citations in the usual form and
manner as prOVided in the Vehicle Code of the State of California.
SECTION 12:: Removal of Vehicles.
The Police Department of the City of Gilroy is hereby
empowered to remove, or cause to be removed to the nearest garage
or other place of safety or to a garage designated or maintained
by the City of Gilroy, any vehicle that is stopped, standing or
parked on any public off-street parking lot in violation of

Sections 5, 6 or 7 of this ordinance, or which is left on such
public off-street parking lot continuously for a period exceeding
24 hours. The provisions of Section 5~5 of the Vehicle Code
of the State of California pertaining to notice to owner and
garage keeper's lien, shall apply in the event of such removal.
SECTION 13: Prima Facie Presumption.
In any prosecution charging a violation of any of the
provisions of this ordinance governing ~he stopping, standing
or parking of a vehicle in any public off-street parking lot,
proof that the particular vehicle described in the complaint was
stopped, standi~g o~.parked in violation of any provision of this
ordinance, together with proof that defendant named in the com-
plaint was at the time of such stopping, standing or parking the
registered owner of such vehicle, shall constitute in evidenc~ a
Drima facie presumption that the registered owner of such motor
vehicle was the person who stopped, left standing or parked such
motor vehicle at the point where and for the time during which

such violation occurred.
SECTION 14: Penalty.
It shall be unlawful for any person to violate any
provision or to fail to comply with any of the requirements of
this ordinance. Any person violating any provisions or failing
to comply with any of the requirements of this ordinance shall
be deemed guilty of a misdemeanor and, upon conviction thereof,
shall be punished by a fine not exceeding One Hundred ($100.00)
Dollars, or by imprisonment not exceedine. thirty (30) days, or
by both such fine and imprisonment. Each such person shall be
deemed guilty of a separate offense for each day during any
portion of which any violation is committed, continued or per-
mitted by such person and shall be punishable therefor as pro-
vided for in this ordinance.

SECTION 15: Consti tutionali ty.
If any section, subsection, sentence, clause, phrase,
or word of this ordinance is for any reason held to be invalid,
such decision or decisions shall not effect the validity of the
remaining portion of this ordinance, The Common Council hereby
declares that it would have passed this ordinance and each section,
subsection, sentence, clause, phrase, and word thereof, irrespec-
tive of the fact that one or more sections, subsections, sentences,
clauses, phrases, or words be declared invalid.
SECTION 16:. This ordinance shall take effect and be
in full force from and after its passage and approval.
