AN ORDINANCE OF THE CITY OF GILROY DECLARING THE
INTENTION OF THE COMMON COUNCIL OF THE CITY OF
GILROY TO VACATE A PORTION OF WELBURN AVENUE
ADJACENT TO WAYLAND LANE
THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN
AS FOLLOWS:
SECTION ONE: The Mayor and Common Council of the City of
Gilroy do hereby declare their intention to vacate a certain
street, public alley, or thoroughfare in the said City of Gilroy,
particularly described as follows, to wit:
BEING a portion of welburn Avenue as shown on the Map of
Tract No. 1785, "Sherwood Park, Unit No.1", which map
is recorded in Book 71 of Maps at pages 28 and 29,
Records of Santa Clara County, and being more particularly
described as follows:
BEGINNING at the corner common to Lots 63 and 64 in the
northerly line of welburn Avenue as shown on said Map
and running thence along ~e northerly line of Welburn
Avenue N. 890 151 w. 107,~7 feet: thence along a curve
to the right with a radi~~ of 20 feet through a central
angle of 670 for a distance of 23.39 feet: to a point
in the easterly line of Hayland Lane; thence southerly
along the grojection of the easterly line of wayland
Lane S. 22 151 E. 17.99 feet; thence along a curve to
the left with a radius of 10 feet through a central
angle of 670 for a distance of 11.69 feet; thence S.
89 15' E. 113.52 feet to an intersection with the
projection of the line common to Lots 63 and 64: thence
N. 700 E. 47.86 feet to a point on the northerly line of
Welburn Avenue as shown on said map; thence westerly
along a curve to the right from a tangent bearing of
S. 700 W. with a radius of 100.00 feet, through a central
angle of 200 451 for a distance of 36.22 feet; thence
N. 890 151 W. 13.29 feet to the point of beginning.
In the vacation of said street, the City of Gilroy shall and
does hereby reserve and except the permanent easement and right
at any time or from time to time to construct, maintain, operate,
replace, remove and renew sanitary and other sewers and drain
and water pipe lines and storm drains in, upon, over and across
the part of said street proposed to be vacated, and pursuant to
any franchise thereof or renewals thereof or otherwise, to construct,
operate, maintain, replace, remove, renew and enlarge lines of
pipes, conduits, cables, wires, poles and other convenient structures,

equipment, and fixtures for the operation of gas pipe lines,
telegraphic and telephone lines, and for the transportation or
distribution of electrical energy and water.
SECTION TWO: This ordinance shall be published and said
street posted as required in the street Vacation Act of 1941, under
which this proceeding is instituted, and the 16th day of January
1959, at 8:00 olclock P. M., at the Common Council chambers, in the
Wheeler Municipal Auditorium, in the City of Gilroy, County of
Santa Clara, state of California, is hereby designated as the
time and place at which said Common Council shall hear any and all
persons interested in or who may object to the proposed vacation.
One publication of this ordinance shall be made in the GILROY
EVENING DISPATCH, a newspaper published in the said City of Gilroy,
at a date at least ten (10) days prior to the said time of hearing.
SECTION THREE:
All ordinances and parts of ordinances in
conflict with this ordinance are hereby repealed.
SECTION FOUR: This ordinance shall take effect and be in
force from and after its passage and approval.
ADOPTED and PASSED this 2nd day of February, 1959, by the
following vote:
