ORDINANCE NO. CO!, OF THE CITY OF GILROY AMENDING SUBDIVISION
(b) SECTION 5 OF ORDINANCE NO. 422 OF THE CITY OF GILROY BY INCREAS-
ING THE AREA REQUIRED FOR A DWELLING BUILDING SITE FROM 5,000 SQUARE
FEET to 7,000 SQUARE FEET.
WHEREAS, the Common Council of the City of Gilroy has hereto-
fore and on the 20th day of ApriL 1959, adopted Resolution No. 504
declaring its intention to institute proceedings for the amendment
of Subdivision (b) Section 5 of Ordinance No. 422 of the City of
Gilroy, commonly known as the Zoning Ordinance, by increasing the
area required for a dwelling building site from 5,000 square feet to
7,000 square feet7 and,
WHEREAS, in said resolution of intention provisions were made
for the reference of the said proposed amendment to the City Planning
Commission of the City of Gilroy in accordance with the provisions
of said Ordinance No. 4227 and,
WHEREAS, the said proposal to so amend Subdivision (b) Section
5 of Ordinance No. 422 was duly referred to the said City Planning
Commission and said Commission has held a public hearing upon the
said proposal after due notice of said hearing was given in accord-
ance with said zoning Ordinance No. 422 and the law of the State of
California7 and,
WHEREAS, the said Planning Commission has duly made its written
report to the Common Council of the City of Gilroy in which it
recommends that the said proposed amendment be adopted and made a
part of the Zoning Ordinance of the City of Gilroy, and
WHEREAS, the Common Council of the City of Gilroy, upon
receiving the aforesaid report of the said City Planning Commission
did, by resolution, fix Monday, the 1st day of June, 1959, at the
Common Council Chambers in the Wheeler Municipal Auditorium at
6th and Rosanna Streets, in the City of Gilro~ at the hour of 8:00 P.M.
of said day, as the place and time for hearing the said proposal to
amend said zoning ordinance as aforesaid, and notice of the said
hearing has been duly given in accordance with said zoning ordinance
No. 422 and in accor~(:);;tt~ ~h~ statutory law of the state of
California7 and,
WHEREAS, the said hearing has now been held at the time and
place aforesaid by the said Common Council of the City of Gilroy,
and after due consideration of the said proposed amendment the said
Common Council deems it is for the best interest for the City of

Gilroy, and/Bhe public interest, that said proposed amendment be
adopted7 and,
WHEREAS, all things have been done and accomplished which are
prerequisite to the right of the Common Council of the City of
Gilroy to adopt the said proposed amendment;
NOW THEREFORE, THE COMMON COUNCIL OF THE CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
Section 1. Subdivision (b) of Section No.5 of Ordinance No. 422 of
the City of Gilroy is hereby amended to read as follows:
(b) Building Site Area Required
Each one-family dwelling, together with its
accessory buildings, hereafter erected shall
be located on a building site in one owner-
ship having an area of not less than seven
thousand square feet, provided, however, that
any parcel of land with an area of less than
seven thousand square feet which is under one
ownership at the time of the adoption of this
ordinance when the owner thereof owns no ad-
joining land or which parcel is shown as a
lot on any subdivision map which is hereafter
recorded in the office of the County Recorder
of the County of Santa Clara, State of California.
after approval of said map by the City Council
in the manner provided by law, may be used as a
building site for one one-family dwelling by
the owner of such parcel of land or by his
successor in interest, provided that all other
regulations for the district, as prescribed in
this ordinance, shall be complied with. In no
case, however, shall there be more than one
dwelling on anyone lot.
Section 2. This ordinance shall take effect and be in full force
from and after its adoption and approval.
ADOPTED AND PASSED this 1st day of June, 1959, by the
