AN ORDINANCE PROVIDING FOR THE ALTERATIONS OF THE BOUNDARIES OF THE
CITY OF GILROY BY THE ANNEXATION THERETO OF CERTAIN UNINHABITED
TERRITORY OWNED BY THE CITY OF GILROY. DESIGNATED AS IIGILROY SEWER
FARM ANNEXATION NOo 1" z UNDER THE ANNEXATION OF UNINHABITED TERRITORY
ACT OF 1939, AND FOR THE INCORPORATION OF SUCH TERRITORY IN AND AS
A PART OF SUCH MUNICIPALITY FOR THE GOVERNMENT AND MUNICIPAL CONTROL
OF SUCH ANNEXED TERRITORY.
WHEREAS, the City of Gilroy is the owner of the premises
hereinafter described and has been the owner of such territory from
a time prior to the initiation of proceedings for the annexation of
such territory; and,
WHEREAS, the Common Council of the City of Gilroy didz
on the 21st day of September, 1959r adopt Resolution # 532 wherein
and whereby it did initiate proceedings to annex the sais territory
to the City of Gilroy as uninhabited territory owned by itr under
the Annexation of Uninhabited Territory Act of 1939; and,
WHEREAS, the description of the premises hereinbefore men-
tioned and hereinafter described was, pripr to the adoption of said
resolution number 532 of -the Common Council of the City of Gilroy.r
submitted to the Boundary Commission of the County of Santa Clara,
and the said Boundary Commission did report approving the definiteness
and certainty.. of the boundaries of said territory; andr
WHEREASq the said Resolution Number 532 did find the fore-
going as facts and did fix Monday, the 2nd day of November, 1959l
at the hour of 8:00 otclock Po Mo in the Common Council Chambers in
the Wheeler Municipal Auditorium at 6th and Rosanna Streets in the
City of GilroY7 as the time and place of hearing of said proposed
annexationz which resolution complied with the provisions of the
Uninhabited Territory Act of 1939; and,
WHEREASq Notice of the said hearing has been given as
required bySection 35311 of the Government Code; and,
WHEREAS~ The said Common Council of the City of Gilroy did
hold the said hearing at the time and place specified in the afore-
said resolution and in the Notice of the hearing, and no objections
or protests to said annexation were filed or made; and~
WHEREAS, the said territory hereinbefore mentioned and
hereinafter describedr being that described in the aforesaid Resolution
Number 532, at all times herein stated was and still is owned solely
by the said City of Gilroy, and during all the said period has been
and still is used for a municipal purpose and the area of said pre-
mises is less than One Hundred (100) acres and said premises are
eligible for annexation to the City of Gilroy under the provisions
of Section 3520105 of the Government Code; and,
WHEREAS, all things required by law to be done, as a
condition precedent to the annexation of said territory to the
City of Gilroy: have been done and accomplishedo
NOW THEREFORE,. THE MAYOR AND COMMON COUNCIL OF THE CITY
OF GILROY DO HEREBY ORDAIN AS FOLLOWS:
SECTION I: The said Common Council of the City of Gilroy

does hereby approve the annexation of the territory hereinbefore
mentioned and hereinafter described to the City of Gilroy, and does
hereby further ordain that the said territory be and the same is
hereby annexed to the City of Gilroy;
The said territory, the annexation of which to the City
of Gilroy is hereby approved and ordained, is all that territory
situated in the County of Santa Clara, State of California, and
more particularly described as follows:
BEING a portion of Las Animas Ranch Lot 51 as shown
on Map No. 7 accompanying the final report of the
Referees in the Las Animas Rancho Partition Suit,
Action Noo 5536, had in the Superior Court of the
State of California, in and for the County of Santa
Clara, and being mar e particularly described as
follows:
BEGINNING at the most westerly corner of Ranch Lot 51
as shown on said Map, and running thence along the
southwesterly line thereof So 320 151 Eo 2207.04
feet to the most southerly corner thereof; thence
along the Southeasterly line thereof No 540 451 Eo
2065.80 feet to the corner co~uon to Ranch Lots 51
and 53 in the Southwesterly line of Ranch Lot 52;
thence along the southwesterly line of Ranch Lot
52 N. 350 151 Wo 316080 feet to the most westerly
corner thereof; thence across Ranch Lot 51 No 350
151 Wo 1781067 feet to a point on the Northwesterly
line thereof; thence along said northwesterly line
S. 570 471 W. 19500 36 feet to the point of beginning
and CONTAINING THEREIN 99017 acres.
SECTION II: The said lands hereby annexed to the City
of Gilroy shall be known as "GILROY SEWER FARM ANNEXATION NO.. 1".
SECTION III: This ordinance shall take effect and be
in full force from and after the date of the filing of a certified
copy of this ordinance in the office of the Secretary of Stateo
