Ordinance 615 ORD:tNANCE NO. 615 ORDINANCE OF THE CITY OF GILROY AMENDING ORDINANCE NO. 422 OF SAID CITY BY REZONING CERTAIN TERRITORY FROM ZONE "E" DISTRICT TO ZONE "D" DISTRICT., AND CERTAIN OTHER PROPERTY FROM ZONE"E" DISTRICT TO ZONE "B" DISTRICT. WHEREAS, the City Planning Commission of the City of Gilroy has heretofore proposed on its own initiative that Zoning Ordinance Noo 422 of the City of Gilroy; be amended by taking from Zone "E" District and placing in Zone "D" District, certain territory in the City of GilroYl and that certain other property also in said Zone "E" District be placed in Zone "B" District, as hereinafter more specifically set forth and has regularly adopted a resolution to that effect; and, WHEREAS, the said Planning Commission did heretofore fix a time and place for hearing protests and objections to said proposed amendment and zoning changes and have caused notice of the time and place of the hearing to be given as required by law and has held the said hearing in accordance with the said notice and no objections or protests to the said proposed zoning change were made; and; WHEREASa-:the said planning commission has duly reported to the Common Council of the City of Gilroy upon the said proposed zoning change in which it has recommended that the said zoning change be made, which report has been duly filed in the office of the City Clerk of the city of Gilroy; and, WHEREAS: the said Common Council did on the 16th day of November, 1959, adopt Resolution No. 546 fixing December 7, 19591 at the Hour of 8:00 olclock P. M. in the Common Council Room of the City Hall, City of Gilroy, at Sixth and Rosanna Streets as the time and place of hearing the said report of the said City Planning Commission and for hearing protests or objections to the proposed change: and notice of the said hearing has been given as required by law and the ordinances of the City of Gilroy, and said hearing - 1 - .-' r I having now been held at the said time and place fixed in the afore- said notice and the Common Council having duly considered the said proposed zoning change and having determined that the said amendment to said ordinance Noo 422 should be adopted and the said zoning changes made as hereinafter set fortho NOW THEREFORE, THE COMMON COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION 1: Ordinance Noo 422 of the City of Gilroy generally known and designated as the "Zoning Ordinance" of the said City, is hereby amended in the following particulars, to wit: That there be taken from Zone "E" District and placed in Zone"D" District the following described premisest to wit: BEGINNING at the Southwest corner of Leavesley Road and Swanston Lane; thence running Southerly along the West line of Swanston Lane to the South line of the City of Gilroy property commonly known as the "Gymkhana Grounds"l thence Southwesterly along the Southerly line of the said city of Gilroy property to the EAsterly line of the Southern Pacific Railroad right of way; thence Southerly along the Easterly line of the Southern Pacific right of way to the north property line of the Gilroy Union High School District; thence Easterly along the Northerly line of the Gilroy Union High School District property to the Westerly line of Swanston Lane; thence along the Westerly line of Swanston Lane Souther- ly to the most Southerly point of said lane, the same being the angle point where said lane turns to the East, thence Easterly along the Southerly line of said Swanston lane to the Easterly line of Forest Street; thence northerly along the Easterly line of Forest street to a north property line of the Gilroy Union High School District; thence Easterly along the projection of the North property line of the Gilroy Union High School District to the East City Limit line at the City of Gilroy; thence Northerly along the East City limit line to the southerly line of Leavesly Road; thence Westerly along the South line of Leavesly Road to the Point of Beginningo Containing approximately 67 acreso THAT there be taken from Zone "E" District and placed in Zone"B" District the following described premises located in the City of Gilroy. COMMENCING at a point in the Easterly City Limits of the City of Gilroy distant thereon 150 feet Northerly of the North line of Old Gilroy Street measured by the shortest distance and running thence in a Westerly direction at a uniform distance of 150 feet from the North line of Old Gilroy Street to the Northeasterly line of Lot 4 in Block 2 South of Ranch 7 East of the City of Gilroy; thence in a Southwesterly direction parallel with the Southerly line - 2 - of 8th Street to the Southwesterly line of East street; thence in a Northwesterly direction along the Southwest line of East Street to the line dividing Lots 1 and 2 in Biliock 2 South; Range 6 East of the City of Gilroy~ and thence in a Southwesterly direction along said dividing line to the center line of the alley extending through said Block; thence in a Northeasterly direction along the said center line of said alley and its Northeasterly prolongation to the center line of Miller Slough; thence up the center line of said slough to the center line of Forest Streetl thence Northeasterly along the center line of Forest street to a point that is 47.34 feet North of the Easterly extension of the Southerly line of Lot 4 of Las Animas sublot 11 and Las Animas Ranch Lot 39 in Las Animas Rancho; thence Westerly at a uniform distance of 47.34 feet Northerly of said Easterly extension of said Lot 4 and~ the Southerly line of said Lot 4 and of Lots 1, 2 and 3 of said Las Animas Sublot 11 and Las Animas Ranch Lot 39 to the Easterly line of the Southern Pacific Railroad, thence Northerly along said Easterly line of said Southern Pacific railroad to the North line of the land of Gilroy Union High School District; thence in an Easterly direction along the North line of said school pro- perty to the Westerly line of Swanston Lane; thence in a Southerly and Easterly direction along the Easterly and Southerly line of Swanston Lane to the Easterly line of Forest Street; thence in a Northerly direction along the Easterly line of Forest Street to the North line of the property of Gilroy union High School District; thence in an Easterly direction along said property line and its easterly prolongation to the Easterly City Limits of the City of Gilroy; thence in a Southerly direction along said City Limits to the point of beginning; EXCEPTING from said area above described the following descriped portions thereof; 10 All that portion now in Zone "B" District which part shall remain in said Zoneo 20 All of Walnut Orchard Park, Tract Noo 1051 as shown on the Official Map thereof on file in the office of the County Recorder of Santa Clara County and the following described territory adjacent thereto, to wit: BEGINNING at the most Westerly corner of said Walnut Orchard Park Tract Noo 1051 in the Easterly line of Forest Street and running thence along the Easterly line of Forest Street to its intersection with South Line of I 0 0 F Avenue, thence Easterly along the South line of I 0 0 F Avenue to the Westep ly line of Lot 6 in said Walnut Orchard Park Tract; thence in a Southerly direction along said Westerly line of said Lot 6 to the Northerly line of Lot 8 in said Tract; thence in a Westerly Direction aong the North line of Lots 8 and 7 of said subdivision to the East line of Forest Street and the point of beginning, which area together with said Walnut Orchard Park Tract above mentioned it is proposed shall be placed in Zone "A" Districto Reference is hereby had to the map and general zoning ordi- nance now on file in the office of the City Clerk of said City of Gilroy. - 3 - l .~ SECT ION 2: That the boundaries of the said Districts and Zones be changed so as to accomplish the foregoing changes in the territory of the respective zoneso SECTION 3: That the Map of the Zoning Ordinance of the City of Gilroy be made to conform to the changes herein set forth.
