ORDINANCE NO. 649
AN ORDINANCE REGULATING THE SOLICITATION OF FUNDS AND OTHER PROPERTY WITHIN
THE CITY OF G[LROY PROVIDING THAT A PERMIT SHALL BE ISSUED THEREFOR AND IM-
POSING PENALTIES FOR THE VIOLATION OF THE ORDINANCE.
The Counci I of the City of Gilroy does ordain as follows:
SECTION I - Permit
It shall be unlawful for any person, firm or corporation to solicit within
the City of Gilroy for a contribution of funds, money or other property to
be used or expended for any purpose or object outside of the City of Gilroy
without first obtaining a permit so to do from the City Administrator and
the Chief of Police.
SECTION II - Statement
Before the City Administrator shall issue such permit the person, firm or
corporation applying therefor shall file a written statement with said City
Administrator and the Chief of Police setting forth the following informa-
tion:
a. The object and purpose for which It is desired to solicit
funds or other property.
b. Who shall have charge and control of said funds and/or pro-
perty.
c. If such funds or property are solicited for permanent organi-
zations or institutions, where such organizations or institu-
tions are located; and
d. If the funds or property are solicited for a corporation or
an association, where such corporation or association is lo-
cated, and who are the incorporators or members thereof.
Such person, firm or corporation shall be required to file the names of
five property holders within the City of Gilroy for reference as to the
responsibility of said person, firm or corporation.
In case of doubt as to the responsibi lity of any person, firm or corpora-
tion so seeking for a permit to solicit for such funds or property, or as
to the consent and responsibility of the property holders whose names are
filed, the permit may be denied and the matter shall be referred to the City
Council for a hearing on said application.
The said City Administrator may require a bond as a prerequisite to the
granting of such permit.
Nothing in this section shall be construed to make it mandatory on the City
Administrator to grant said permit, where the public peace or safety might
be endangered in so doing.
SECTION 1[[ - Penalty
Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor, and upon conviction thereof shall be punish-
able by a fine of not more than Five Hundred Dollars ($500.00) or by Im-
prisonment in the City Jailor in the County Jail of the County of Santa
Clara for a period of not more than six months, or by both such fine and
Imprisonment.

This ordinance shall be In force and go Into effect thirty (30) days from
and after the date of Its passage and approval.
This Ordinance was introduced and read on the 20th day of March, 1961,
and passed and approved on the 3rd day of April, 1961 by the following vote:
