ORDINANCE AMENDING THE UNIFORM BUILDING CODE OF THE
CITY OF GILROY BY ADDING SECTION 1506 THERETO REGULAT-
ING THE CONSTRUCTION OF FALLOUT SHELTERS.
The Council of the City of Gilroy does ordain as follows:
SECTION 1. The uniform building code adopted by reference
in Section 6.1 of tne said Gilroy City Code, is hereby amended by
the addition thereto of a new section to be known as Section 1506
to read as follows:
Section 1506. Group J occupancies shall also include:
Division 3, Fallout shelters for the use of families,
which shall comply with the following special
provis ions:
(1) Family Fallout shelters shall be used for emergency
use only.
(2) The structure shall be of materials approved by
the City Building Inspector.
(3) Sanitary facilities connected to sewers shall not
be permitted.
(4) Minimum height of rooms shall be 6 feet 6 inches.
(5) Ventilation to be as recommended by the Civil Defense
Authority.
(6) No light source depleting the oxygen content of air
in the shelter may be used.
(7) Entrance and exit facilities shall be at least 24
inches wide; hatchways shall be at least 24 inches wide
in the minimum dimension.
(8) Corridor and stairs shall have a minimum width of
24 inches and a minimum height of 6 feet 6 inches.
(9) The materials of construction to provide fallout
radiation protection shall consist of the equivalent of
3 feet of earth or 300 pounds per square foot of mass.
SECTION 2. All Ordinances and parts of Ordinances in
conflict herewith are hereby repealed.
SECTION 3. This Ordinance is an emergency Ordinance and
shall take effect ~ediate1y upon passage and approval. The facts
constituting said emergency are as follows:
The relations between the United States and the Soviet
Government are such that the United States is threatened
with atomic v~fare which could break out at any time and

without any appreciable warning and without the people of
the United states anywhere having any opportunity to protect
themselves; that the only known method of protection at the
present time is through the construction of shelters having
at least the general specifications above setforth and the
present uniform building code, which is the building code of
the city of Gilroy; will not permit the construction of such
shelters and the building code should be amended to permit
the immediate construction of the aforesaid shelters; that
the specifications hereinbefore setforth are only minimum
requirements and shall not be construed to prohibit stronger
or more protective shelters.
PASSED AND ADOPTED this 2nd day of October, 1961, by the
following vote:
