ORDINANCE NO. 677
AN ORDINANCE OF THE CITY OF GILROY ADDING
SECTION 16.28 REGULATING THE OPERATION AND
CONDUCT OF CARDROOMS IN THE CITY OF GILROY

The Council of the City of Gilroy does ordain as follows:
SECTION I
The following regulations shall be and are hereby adopted
for the conduct and operation of CARDROOMS for which a
license is required under the provisions of Subdivision
14 of Section 13.46 of the Gilroy City Code:
a. No cardroom for which a license is required shall
remain open between the hours of 2:00 a.m. and
6:00 a.m. of any day.
b. There shall be at least two adequate and proper
means of ingress and egress to the ~ediate area
of the card tables.
c. All persons, including proprietors, dealers and
other persons receiving salaries, wages or other
compensation from the operation of a cardroom
shall, at all tllnes when in or about the card-
room, have in his possession a permit issued by
the Chief of Police. A permit shall not be issued
to anyone who has been convicted of a felony or a
crllne involving moral turpitude. Atemporary per-
mit may be issued until the investigation of his
record is completed.
The Chief of Police shall maintain proper
records of all such permits issued, including fin-
ger prints and photographs.
d. No licensee, proprietor or operator of a cardroom
shall allow house players, shills or dummies to
engage in card games.
e. No licensee, proprietor or operator of a cardroom
shall allow minors or any intoxicated person within
any rooms wherein card games are played while such
games are in progress.
SECTION 2
It shall be unlawful for any person to violate any of the
regulations or provisions of this section of the Gilroy City
Code or of this ordinance. Upon conviction for violation of
any of the preceding sections of this ordinance or of any
state law regulating card games, the Chief of Police may
recommend to tee Council that a cardroom license be suspended
or revoked. The Council at its discretion, may revoke or
suspend such license.
SECTION 3
This ordinance shall take effect and be in force 30 days from
and after its adoption and approval.

SECTION 4
If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be unconstitutional, such
decision shall not affect the validity of the remaining por-
tions of this ordinance. The legislative body hereby declares
that it would have passed this ordinance and each section, sub-
section, sentence, clause and phrase thereof, irrespective of
the fact that anyone or more sections, subsections, sentences,
clauses or phrases be declared unconstitutional or invaled.
This ordinance was introduced and read on the 16th day of
April, 1962 and passed and adopted on the ]thday of May, 1962
by the following vote:
