AN ORDINANCE OF THE CITY OF GILROY AMENDING SUBDIVISION
4 OF SECTION 13.40 OF THE GILROY CITY CODE BY PROVIDING
THE LICENSE FEE TO BE PAID BY AUCTIONEERS MAINTAINING
A FIXED PLACE OF BUSINESS IN THE CITY OF GILROY ( DIVIDING
SAID AUCTIONEERS INTO TWO CLASSES1 AND PROVIDING FOR A
LARGER FEE TO BE PAID BY AUCTIONEERS HAVING NO FIXED
PLACE OF BUSINESS IN SAID CITY, DECLARING THE ORDINANCE
TO BE AN EMERGENCY MEASURE,AND THE FACTS CONSTITUTING
THE EMERGENCY
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
Section I: Subdivision 4 of Sec. 13.40 of the Gilroy City
Code is hereby amended to read as follows:
(4) Auctioneer. Auctioneers not maintaining fixed place
of business in the City of Gilroy shall pay $50.00 for
the first day of an auction and $25.00 for each day there-
after.
Auctioneers maintaining a fixed place of business in
the City of Gilroy, for the purposes of this ordinance,
shall be divided into two (2) classes:
Class A shall include auctioneers conducting auctions
of second-hand goods or property.
Class B shall include auctioneers conducting auctions
of both new and second-hand goods or property.
Class A auctioneers shall pay a license fee of $50.00
per year or $10.00 per day for each day auctions are conducted
at said fixed place of business. If conducted at any other
place, the fee shall be the same paid by an auctioneer not
maintaining a fixed place of business in the City of Gilroy.
Class B auctioneers shall pay a license fee of $150.00
per year or $25.00 per day for each day auctions are conducted
at said fixed place of business. If conducted at any other
place, the fee shall be the same paid by an auctioneer not
maintaining a fixed place of business in the City of Gilroy.
Section II: This is hereby declared to be an amergency ordinance
and shall take effect immediately upon its adoption and approval.
The facts constituting such emergency are as follows: Auctioneers
from other cities often hold auctions within Gilroy, -at which sales
are made of new and second-hand personal property, often of poor
grade or quality, from a bankrupt or insolvent store, to inhabitants
of Gilroy under conditions amounting to or approaching fraud and
deceit, to the disadvantage of Gilroy merchants and to the loss of
the buyers at the auction and said auctions should be discouraged.
Section III: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
