ORD I NANCE NO. 777
ORDINANCE OF THE CITY OF GILROY FIXING THE AD VALOREM ASSESSMENT FOR THE CURRENT
FISCAL YEAR 1966-67 NECESSARY TO SUPPORT THE DEPARTMENTS AND BONDED INDEBTED-
NESS OF THE CITY OF GILROY AND THE CITY OF GILROY PARKING DISTRICT NO. ~.
WHEREAS, the City Counc i 1 has adopted Ord i nance No. 776 fix i ng
the amount of revenue from property taxes necessary to support its departments
for the current year 1966-1967 and to pay the bonded and other indebtedness of
the City or any portion, or district of the City; and
WHEREAS, Section 51511 of the Government Code requires that the City
Legislative body annually before September 1st fix the rate of taxes or rates
of taxes if different portions or districts require different rates, designated
in the number of cents upon each $100.00 using as a basis the value of the pro-
perty as assessed and equal ized, which rates shall be sufficient to raise the
amount fixed by ordinance or resolution and the expenses of collection; and
WHEREAS, the City Council has adopted Ordinance No. 776 fixing
the amount of revenue required to support its departments and pay for its
Bonded Indebtedness for the current year at the sum of $238,133.00, and to raise
the said sum will require a tax rate for the current fiscal year of $1.35 on pro-
perty within Code areas No. 2-000, 2-006 and 2-007 and $1.34 in Code areas No.
2-001, 2-002, 2-004 and 2-005, for each $100.00 value of property as assessed
and equal ized and said rates should be adopted as the tax rates for said current
fiscal year, and
WHEREAS, the City of Gilroy has also adopted in said Ordinance No.
776 the fixed amount of revenue, in the amount of $6,77t.OO required by the
City of Gilroy Parking District No.1 to pay its bonded indebtedness and mainten-
ance expense, and to raise said sum will require a tax rate for the current fiscal
year of $2.21~ on land only within said district which is Code area No. 2-007,
for each $100.00 value on land assessed and equal ized and said rate should be

adopted as the tax rate for said current fiscal year,
NOW THEREFORE, BE IT ORDAINED that the tax rates for the fiscal year
1966-67 for the City of Gilroy shall be as follows:
Section 1. That the tax rate shall be $1.35 on property within said
Code Areas No. 2-000, 2-006 and 2-007 and $1.34 on property in said Code Areas
No. 2-001, 2-002, 2-004 and 2-005, for each $100.00 value of property as assessed
and equa 1 i zed.
!'Section 2. Assessment Levy. An ad valorem assessment in the amount
of $2.218 on each $100 of assessed valuation upon all land (exclusive of publ ic
property in use in the performance of a pub1 ic function) within the special
assessment district, Code Area No. 2-007, formed in the proceedings pursuant to
Resolution No. 837 of Preliminary Determination and of Intention for the proposed
acquisition and construction of parking faci1 ities and the formation of Parking
District No. 1 is hereby levied for the payment of maintenance expense and the
principal and interest on the indebtedness incurred in said proceedings and due
on Bond Plan D, City of Gilroy Parking Bonds of 1965.
Said assessment shall be collected in the same manner and be subject
to the same penalties, costs and interest, and may be redeemed, and the property
sold for nonpayment thereof, and title shall pass to the purchaser, as provided
for City Taxes, except that the period of redemption shall be one year instead
of five.11
Section 3. That there shall be immediately transmitted to the County
Auditor or County official performing the duties of a County Auditor, a statement
of the tax rates as herein fixed.
Section 4. For the reason that Article VI of the Gilroy Charter
provides that an ordinance declaring the amount of money necessary to be raised
for taxation or fixing the rate of taxation or levying the annual tax upon
property, need not be publ ished and can be made effective immediately upon
adoption, this ordinance shall take effect from and after its adoption and

approval, but the City Clerk shall cause at least the Title and summary of this
ordinance to be publ ished onee in the official newspaper of the City within
fifteen (15) days after its adoption.
