Ordinance 780 ORDINANCE NO. ~ ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY REMOVING CERTAIN PROPERTY IN THE AREA HERETOFORE ANNEXED TO THE CITY OF GILROY DESCRIBED AS SOUTHWEST ANNEXATION 65-2~ NOW ZONED Cl AND R3 AND PIACING SAME IN ZONE Rl,. COMBINED WITH "s" ZONE REGUIATIONS WHEREASI; the Planning Commission of the City of Gilroy has heretofore proposed on its own initiative that the Zoning Ordinance of said city be amended as follows: That there be taken from "R-3"z a multiple residence district,. and "C-l" a neighborhood- commercial district,. and placed in "R-l"l; a single-family residence districtz the following described property located in the City of Gilroy,. Santa Clara County,. California: BEING a portion of the Las Animas Ranch Lot 16 as shown on Map No. 7 accompanying the Final Report of the Referees in the Las Animas Rancho Partition Suit,. Action No. 5536 had in the superior Court of the State of California,. in and for the County of Santa Clarar and being more particularly described as follows: "BEGINNING at a point in the southwesterly line of that certain 41.72 acre parcel of land described in the Deed from C. N. Smith to Frank Filice, et ux, dated February 15r 1952,. and recorded February 15, 1952, in Volume 2366 at page 302, Official Records of Santa Clara County; distant thereon S. 20000' E. 92.00 feet from a granite monument at the original southwesterly corner of the City of GilroYr and running thence parallel with the original southeasterly line of the City of Gilroy N. 700 E. 1133.00 feet; thence S. 200 01'30" E. 210.00 feet; thence N. 700 E. 238.07 feetr more or lessr to a point in the southwesterly line of Rosanna Annexation No. 1 to the City of Gilroy as described in Resolution No. 920 of said City adopted May 3r 1965; thence along the southwesterly line of said Annexation S. 20Q01'E. 1021.93 feet to the southwesterly corner thereof; thence along the southerli line thereof S. 890 55150" W. 475.00 feet; thence N. 10 42' 53" E. 407.12 feet; thence S. 700 W. 1133.00 feet to a point in the southwesterly line of said 41.722 acre parcel first above referred to; thence along said southwesterly line N. 200 W. 720.00 feet to the point of beginning, and CONTAINING THEREIN 25.099 acres." and rezoning from "C-11I District to IIR-l" District the following described portion aE the said IIS0UTHWEST ANNEXATION 65-2 TO THE CITY OF GILROY". BEING a portion of Las Animas Ranch Lot 16 as shown on Map No. 7 accompanying the Final Report of the Referees in the Las Animas Rancho Partition Suit, Action No. 5536 had in the Superior Court of the State of Californiar in and for the County of Santa Clara,. and being more particularly described as follows: 160 (1) IIBEGINNING at a point in the southwesterly line of Rosanna Annexation No. 1 to the city of Gilroy as mescribed in Resolution No. 920 of the said City adopted May 3,. 1965r distant thereon S. 20Q 011 30" E. 92.00 feet from the north- westerly corner thereof in fue original southeasterly line of the City of GilroYr and running thence along said south- westerly line S. 20Q 01' 30" E. 210.00 feet; thence S. 700 00' W. 238.07 feet; thence N. 20Q 01' 3011 w. 210.00 feet; thence N. 700 00' E. 238.07 feet to the point of beginningr and CONTAINING THEREIN 1.15 acres.1I Said rezoned area to be subject to liS" zone regulations. AND WHEREAS,. a hearing was duly held before the said Planning Commission upon its said proposal to so amend the said zoning Ordinance on the 6th day of October, 1966,after notice had been duly and regularly given of the time and place of hearing; and WHEREAS,. at said hearing the said Planning Commission did adopt a resolution reporting to the Council of the City of Gilroy upon its said proposal to so amend said ordinance, in which report it recommended that the amendment be adopted by the Council; and WHEREASr the Council did heretofore and on the 24th day of October, 1966 fix Monday, the 7th day of November, 1966, at the hour of 8:00 o'clock p.m., in the Council Chambers of the City Hall, at No. 10 South Rosanna Street, GilroYr California, as the time and place for hearing the said report of the said Planning Commission and considering the matter of said amendment, and notice of the said hearing before the Council has been given in the manner and for the period required by the Zoning Ordinance of the City of Gilroy and by lawr and the Council has now held the said hearing and received evidence upon the said proposed amendment from which it appears that the recommendation of the Planning Commission thereupon should be approved, and that the said Zoning Ordinance should be so amended. NOW THEREFORE, the Council of the City of Gilroy does ordain as follows: Section 1: The Zoning Ordinance of the City of Gilroy shall be and is hereby amended as follows: That the property and territory (2) hereinbefore described in the preamble to this Ordinance is hereby removed from the zoning classification in which it now stands and is placed in and made subject to the regulations of Rl,. single family residential district, and also made subject toilS" Zone Regulations. Section 2: The zone map of the City of Gilroy shall be changed and amended to reflect the change in the zoning of the aforesaid territory. Section 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall be in full force and effect 30 days from and after its passage and adoption.
