ORDINANCE NO. ~
AN ORDINANCE OF THE CITY OF GILROY VACATING AND ABANDONING
ALL THAT PORTION OF MAPLE STREET BETWEEN EIGHTH STREET AND
OLD GILROY STREET
WHEREAS, the Council of the City of Gilroy has heretofore and
on the ~ day of
December
, 1966, passed and adopted
Resolution No. 1068 declaring its intention to proceed under the
street Vacation Act of 1941 to vacate a portion of a certain street
in the City of Gilroy hereinafter described; and
WHEREAS~ the City Council of the City of Gilroy, in accordance
with said Street Vacation Act of 1941, has caused notices of the
adoption of said resolution to be published in the Gilroy Evening
Dispatch~ a newspaper of general circulation; published in the said
City of Gilroy, in the manner and form required by law, and the
said street or thoroughfare has been posted in the manner and form
required by lawi and
WHEREAS, no objection to the said proposed vacation of said
street has been filed at or before the hearing held by said council
on the 3rd day of January, 1967, at the hour of 8:00 o'clock p.m.,
at the Council Chambers in the City Hall, at No. 10 South Rosanna
Street, in the said City of Gilroy, the time and place fixed for
the hearing in said notices, and the said hearing has been held
at the said time and place, and the council has duly considered the
matter of vacating the said street, as the same is hereinafter
described and has determined that said premises are no longer
needed or required for public purposes by the said city of Gilroy.
NOW THEREFORE, the Council of the City of Gilroy does ordain
as follows:
Section 1. The following described portion of Maple street,
being the premises hereinbefore mentioned, within the said City of
Gilroy, is hereby vacated and abandoned:

All that portion of Maple street in the said City of
Gilroy lying between Eighth street and Old Gilroy
street.
section 2. The council does declare that the public convenience
and necessity requires the reservation of easement and right-of-way
for structures enumerated in section 8330 of the streets and Highways
Code of the State of Californiar and the vacation and abandonment
of the portion of Maple Street hereinabove described shall be and
is subject to the reservation and exception of the permanent ease-
ment and rightat any time or from time to time of the City of
Gilroy to construct, maintain, operate, replace, remove, and renew
sanitary sewers and storm drains and appurtenant structures in,
upon, over and across any street or part thereof proposed to be
vacated and pursuant to any existing franchises or renewals thereof,
or otherwise, to construct, maintain, operate, replace, removel
renew and enlarge lines of pipe, conduitsl cables, wires, polesg and
other convenient structures1 equipment and fixtures for the operation
of gas pipe lines, telegraphic and telephone lines, railroad lines,
and for the transportation or distribution of electric energy,
petroleum and its products, ammonia, waterl and incidental purposes,
including access and the right to keep the property free from
inflammable materialsz and wood growthl and otherwise protect the
same from all hazards in, upon and over the street or part thereof
proposed to be vacated.
Section 3. This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
Section 4.
The foregoing ordinance was introduced at a
regular meeting of the council and ordered published by title and
summary at a regular meeting of the City Council held on the 3rd
day of January, 1967, and was finally adopted and passed at a regular
