ORDINANCE NO. 798
ORDINANCE OF THE CITY OF GILROY AMENDING
SECTIONS 5.5, 5.7 and 5.10 OF CHAPTER 5
OF THE GILROY CITY CODE BY ELIMINATING FROM
SAID SECTIONS ANY CHARGE FOR REGISTERING OR
LICENSING OR REREGISTERING BICYCLES.
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
Section 1. Sec. 5.5 of the Gilroy City Code is hereby
amended to read as follows:

loss, etc., of license plate; cancellation of
prior registration.
In the event that the license plate for any bicycle
is lost, stolen or mutilitated, the person owning
any such bicycle shall make an application to re-
register such bicycle and a new license plate shall
be procured from the chief of police. The chief of
police shall cancel the registration of such bicycle
in the permanent register and such bicycle shall be
registered, and if necessary, be given a new serial
number and identifying letter. (Ord. No. 471, ~ 1;

Section 2. Sec. 5.7 is hereby amended to read as

Sec. 5.7. License - Required; procurement; exemptioni
renewal; duration;
It shall be unlawful for any person to operate or
use, or cause or permit to operate or use any registered
bicycle in, along or across any public highway in the
city unless there shall have been first obtained by or
on behalf of the owner of such bicycle a license to do
so, which license shall be procured from the chief of
police. The provisions of this section shall not apply
to any bicycle owner not a resident of the city, provided,
the bicycle owned by himhas affixed thereon a valid
unexpired license of any city or county within the
state.
Each such license shall be subject to renewal whenever
the ownership of the bicycle changes. Each such license
when so issued shall entitle the licensee to operate such
bicycle for the remainder of the period for which the
license has been issued. Each license period shall be three
years. The first license period shall begin on January I,
1962 and shall end December 31, 1964. A new application
for a license shall be filed and a new license obtained
prior to the fifteenth day of the first January of each

Section 3. Sec. 5.10 of the Gilroy City Code is
hereby amended to read as follows:
Sec. 5.10. Same - License plate required to be
attached; bicycle must be registered prior to
issuance of license; impounding of unlicensed
bicycles;
No person shall operate any bicycle on, along
or across any public highway in the City unless
the license plate issued therefor is maintained
upon such bicycle for which issued and attached
thereto; provided, however, that no license
provided for under the provisions of this chapter shall
be issued by the chief of police until the bicycle
described therein has been registered by the chief
of police. The chief of police may impound and
retain possession of any bicycle that does not have affixed
thereon a valid unexpired license plate until such time
as the owner thereof shall have obtained a license under
the provisions of this chapter. (Ord. No. 471 ~ 4; Ord.

Section 4. All Ordinances and parts of Ordinances in
conflict herewith are repealed.
