ORDINANCE NO. 799
ORDINANCE OF THE CITY OF GILROY REZONING THE
16.44 ACRE TRACT OF LAND OF MARGIORINI CHIESA
FRONTING MONTEREY HIGHWAY NORTH OF FARRELL
AVENUE IN THE WREN - MONTEREY - FARRELL
ANNEXATION FROM R-l DISTRICT TO C-2 DISTRICT,
THE REZONED TRACT TO BE SUBJECT TO II S II ZONE
REGULATIONS AND TO THE PROSPECTIVE ESTABLISHMENT
OF PLAN LINES FOR THE NORTHERLY EXTENSION OF
CHURCH STREET.
WHEREAS, the Planning Commission of the City of Gilroy
has adopted and filed with the City Clerk its report and
recommendation upon the application of Margiorini Chiesa for
the rezoning from R-l District to C-2 District the 16.44 acre
tract fronting Monterey Highway North of Farrell Avenue in
the Wren - Monterey - Farrell Annexation, and in which report
the said Commission recommends that all of said premises lying
within a distance of 300 feet from the westerly line of Monterey
Street be zoned C-2 District, and the remaining portion of said
16.44 acre tract be zoned R-4 District, the rezoned area to be
subject to the prospected establishment of plan lines for the
Northwesterly extension of Church Street; and
WHEREAS, It appears that the Planning Commission
adopted the foregoing Resolution at a regular meeting thereof
held on the 4th day of May, 1967, and due notice of the hearing
of said application was given as required by the Zoning Ordinance
of the City of Gilroy; and
WHEREAS, Notice of the hearing before the Council of
the said report and recommendation of the said Planning Commission
has been given as required by law, in which notice the 5th day of
June, 1967, at the hour of 8:00 p.m. at the Council Chambers of
the City Hall, No. 10 South Rosanna street, Gilroy, California,
was fixed as the time and place for the hearing of said report;
and said hearing has now been held in accordance with said
noticei and

WHEREAS, From the evidence presented at the said hearing
before the Council and from the Resolution of the Planning Commission,
it appears that the said premises should be rezoned in accordance
with the said action of the Planning Commission;
NOW THEREFORE, The Council of the City of Gilroy does
ordain as follows:
Section 1. The report and recommendation of the said
Planning Commission upon the said application of
Margiorini Chiesa for rezoning of said 16.44 acre
tract of land is hereby approved and the said premises
are hereby rezoned in accordance with the said report and
recommendation of said Planning Commission, said premises
to be subject to "s" Zone regulations.
Section 2. The Zoning Map of the City of Gilroy
shall be changed to reflect the foregoing rezoning.
Section 3. All Ordinances and parts of Ordinances
in conflict herewith are hereby repealed and this
Ordinance shall take effect and be in full force
and effect thirty (30) days from and after its adoption
and approval.
The foregoing Ordinance was introduced and ordered
published by title and summary at a regular meeting of the
Council held on the 5th day of June, 1967, by the following
vote:
