ORDINANCE NO. 804
ORDINANCE OF THE CITY OF GILROY REZONING
THE 4.865 ACRE TRACT OF LAND BELONGING TO
JOE F. FILICE LOCATED IN THE SOUTHEASTERLY
PORTION OF GILROY FROM R-l TO M-2 DISTRICT
SUBJECT TO IISII DISTRICT REGULATIONS.
WHEREAS, the Planning Commission of the City of Gilroy has
adopted and filed with the City Clerk a Resolution constituting
its report and recommendation upon the application of JOE F. FILICE
to rezone from R-l District to M-2 District, the following described
premises situated in the City of Gilroy, County of Santa Clara,
State of California:
BEGINNING at a stake set at the point of intersection
of the Northeasterly City Limits of the City of
Gilroy with the southerly line of the Old Gilroy Road,
now known as Pacheco Pass Road, as said road existed
prior to September 12, 1922, thence running along the
following courses and distances, to wit: North 890
541 East 263.69 feet; South 850 16' East 13.20 feet;
South 750 371 East 13.20 feet South 650 581 East 13.20
feet; South 560 191 East 13.20 feet; and South 510301
East 527.32 feet to the most easterly corner of that
certain 2.244 acre tract of land conveyed by Miller &
Lux Incorporated, a corporation, to John Frechou, by
Deed dated May 1, 1925, and recorded June 3, 1925 in
Book 164 of Official Records, page 147, records of
Santa Clara County, California; thence leaving said
line of samd road and running along the southeasterly
line of said 2.244 acre tract South 700 West 565.23
feet to a point on the Northeasterly Gilroy City Limits
line; thence running North 200 West and along said line
571.59 feet to the point of beginning.
Containing 4.865 acres of land, and being a portion of
Las Animas Ranch Lot 44. Compared
and,
WHEREAS, it appears that the Planning Commission adopted the
foregoing Resolution at a regular meeting thereof held on the 6th
day of July, 1967, and due notice of the hearing of said appli-
cation was given as required by the Zoning Ordinance of the City
of Gilroy; and,
WHEREAS, the notice of the public hearing before the Council
of the said report and recommendation of said Planning Commission

has been given as required by law, in which notice the 7th
day of
Augus t
,1967, at the hour of 8:00 P.M. in the Coun-
cil Chambers of the City Hall, No. 10 South Rosanna Street, Gil-
roy, California, was fixed as the time and place fr the hearing
of said report and recommendation and said hearing has now been
held in accordance with said notice; and
WHEREAS, from the evidence presented at the said hearing be-
fore the Council and from the Resolution of the Planning Commis-
sion, it appears that the said premises should be rezoned in ac-
cordance with the said recommendation of the Planning Commission.
NOW, THEREFORE, the Council of the City of Gilroy does ordain
as follows:
Section 1. The report and recommendation of the said
Planning Commission upon the said application of said
JOE F. FILICE for the rezoning of said 4.865 acre
tract of land hereinbefore described is hereby approved
and the said premises are hereby rezoned from R-l Dist-
rict to M-2 District, said premises to be subject to
"S" District Regulations.
Section 2. The Zoning Map of the City of Gilroy
shall be changed to reflect the foregoing rezoning.
Section 3. All Ordinances and parts of Ordinances in
conflict herewith are hereby repealed and this Ordi-
nance shall take effect and be in full force and effect
thirty (30) days from and after its adoption and appro-
val.

by title and summary at a regular meeting of the Council held on

No. 804 is an original ordinance, duly adopted by the Council
of the City of Gilroy at a regular meeting of said Council held on
the 21st day of August ,1967, at which meeting
a quorum was present.
I further certify that the said ordinance has been pub-
lished in accordance with the charter of the City of Gilroy.
