ORDINANCE NO. 843
AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF
GILROY FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS
OF SAID CITY PROPOSITIONS FOR THE INCURRING OF
BONDED INDEBTEDNESSES OF SAID CITY FOR THE ACQUISI-
TION~ CONSTRUCTION AND COMPLETION OF CERTAIN MUNICIPAL
IMPROVEMENTS; DECLARING THE ESTIMATED COST OF SAID
IMPROVEMENTS, THE AMOUNT OF THE PRINCIPAL OF EACH OF
SAID INDEBTEDNESSES TO BE INCURRED THEREFOR, AND THE
MAXIMUM RATE OF INTEREST TO BE PAID THEREON; FIXING
THE DATE OF SAID ELECTION) THE MANNER OF HOLDING THE
SAME AND PROVIDING FOR NOTICE THEREOF
THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS:
WHEREAS, the City Council of the City of Gilroy, by Resolution
passed and adopted at a regular meeting of said Council
No. 1309
on
January 20
, 1969, by the affirmative vote of mor~ than
two thirds of all of its members, did determine that the public
interest and necessity demanded the acquisition, construction and
completion of the municipal improvements therein named and as
hereinafter mentioned, and did further determine that the cost
of said proposed municipal improvements) and each of them) will
be too great to be paid out of the ordinary annual income and
revenues of said City and that said indebtednesses) and each of
them) will require an expenditure of funds greater than the amount
allowed for them by the annual tax levy of said City;
NOW, THEREFORE, IT IS ORDERED) as follows:
1. A special municipal election be, and it is hereby, called
and ordered and will be held in the City of Gilroy on Tuesday, the
8th day of April, 1969, at which election shall be submitted to
the qualified voters of said City the question of incurring bonded
indebtednesses by said City for the objects and purposes set forth
in the following propositions, to wit:

PROPOSITION NO.1: ilSha11 the City of Gilroy
incur a bonded indebtedness
(Library) in the principal amount of
$6003000 in accordance with
the provisions of the Ordinance calling the election at
which this proposition is submitted, for the object and
purpose of the acquisition of real property and the con-
struction and completion thereon of a library building,
including land and rights in land, site clearing and
development, building, parking facilities, landscaping,
furniture, furnishings, equipment, facilities and appur-
tenances, and all things auxiliary thereto and necessary
to complete the same?"
PROPOSITION NO.2: "Shall the City of Gilroy
incur a bonded indebtedness
(Park Improvement) in the principal amount of
$150,000 in accordance with
the provisions of the Ordinance calling the election at
which this proposition is submitted for the object and
purpose of making certain additions and improvements to
the City's Northside Park encompassing the construction
and completion of park facilities for community use,
including structures ,and equipment ,and incidental works
and structures necessary or convenient to the maintenance
and operation of a park?"
PROPOSITION NO.3:
"Shall the City of Gilroy
incur a bonded indebtedness
in the principal amount of
$200,000 in accordance with
the provisions of the
Ordinance calling the election at which this proposition
is submitted for the object and purpose of the acquisition
of real property and the construction and completion
thereon of a headquarters fire station; the completion
of grading, paving and site preparation of such real
property; the purchase of furniture and equipment to
furnish said headquarters fire station; and the purchase
of fire apparatus and its equipment; and the acquiring
of all lands, easements, facilities and appurtenances
and the completion of all incidental work necessary
therefor?"

2. The estimated cost of the municipal improvements set
forth in each proposition and the amount of the indebtedness to
be incurred therefor3 including legal and other fees, costs of
printing the bonds and other costs and expenses incidental or
connected with the authorization, issuance and sale of the bonds
therefor is as follows:

3. The Council does hereby submit to the qualified voters
of said City of Gilroy at said special municipal election, this
Ordinance and the propositions set forth in Section 1 hereof.
The Council proposes to issue and sel] bonds of said City in the
amounts and for the objects and purposes specified in said proposi-
tions, or any of them, if two thirds of the qualified electors
voting on such propositions, or any of them, at said special municipal
election shall vote in favor thereof.
4. If two thirds of the qualified electors voting on any
of said propositions shall vote in favor thereof, said proposition
shall be deemed adopted. Said bonds shall be negotiable in form
and of the character known as serial, and shall bear interest at
a rate not exceeding six percent (6%) per annum, payable semi-
annually except that interest for the first year after the date
of the bonds may be made payable at the end of said year.
5. The said special municipal election shall be held and
conducted, the votes thereof canvassed, the returns thereof made,
and result thereof ascertained and determined as herein provided,
and in all particulars not prescribed by this Ordinance said
election shall be held as provided by law for the holding of
municipal elections in said City.
6. The said special municipal election is hereby consolidated
with the general municipal election which will be held within the
City of Gilroy on Tuesday, the 8th day of April, 1969. The special
municipal election shall be held in the manner provided for the
general municipal election, and the election precincts, polling
places, and officers of election shall be the same as those set
forth in the notice of election officers and polling places proposed
to be published in the Gilroy Evening Dispatch ,
a newspaper of general circulation published and circulated in the
Ci ty of Gilroy on or about February 24 , 1969.

7. The elections hereby consolidated shall be held in all
respects as if there were only one election, and only one form of
ballot shall be used.
8. All persons qualified to votp- at municipal elections in
said City upon the date of the election herein provided for shall
be qualified to vote upon the propositions submitted at said
special municipal election.
9. Ballots for the election shall be provided of the form
and to the number provided by law. On said ballots, in addition
to any other printed matter which may be required by law, two
voting squares shall be set off to the right of each proposition
submitted at the election as set forth in Section 1 of this
Ordinance in the manner provided by law, one having the word
"YES" printed before it and the other having the word "NO" printed
before it.
10. Each voter may vote on any of the propositions hereby
submitted. Each voter to vote for a proposition and for incur-
ring said bonded indebtedness shall stamp a cross (X) in the blank
space opposite the word "YES" on the ballot to the right of the
proposition, and to vote against a proposition and against the
incurring of said indebtedness shall stamp a cross (X) in the
blank space opposite the word "NO" on the ballot to the right of
the proposition.
11. The polls shall be opened at 7:00 o'clock A.M. of the
day of the election and shall be kept open until 8:00 o'clock
P.M. of the same daY3 when the polls shall be closed, except as
to voters in line as provided in Section 14436 of the Elections
Code.
12. The City Clerk is hereby authorized and directed to
procure all supplies necessary for the proper conduct of said
election.

13. This Ordinance is adopted pursuant to Article 1, comprising
Sections 43600 to 43638, inclusive, of Chapter 4, Division 4, Title
4 of the Government Code of the State of California.
14. This Ordinance shall be published once a week for two
(2) weeks in the
Gilroy Evening Dispatch
,
a newspaper published less than six (6) days a week in said City,
and such publication shall constitute notice of said election. No
other notice of the election hereby called need be given.
15. This Ordinance, being an Ordinance calling and ordering
an election, shall take effect immediately upon its adoption.

Council of the City of Gilroy, at a regular meeting of said
Council held on the 20th day of January, 1969, and thereafter
duly adopted by the Council of said City at a meeting of said
Council held on the 3rd day of February "1969,, at which
meeting a quorum was present.
I further certify that the said Ordinance has been published
in accordance with the Charter of the City of Gilroy.
