ORDINANCE NO. 847
AN ORDINANCE AMENDING SECTION 19.91 AND
ADDING SECTIONS 12.23-1 AND 27.36-1 OF
THE CITY CODE SO AS TO PROVIDE UNIFORM
PENALTIES FOR UNPAID AND DELINQUENT
GARBAGE, SEWER AND WATER CHARGES AND
FEE S.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Sec. 19.91 of the Gilroy City Code is amended
to read as follows:
Sec. 19.91 Penalty for delinquency
Whenever any sewer service and use charges become
delinquent for not being paid for a period of one month,
thereafter there shall be imposed a monthly penalty
equal to three per cent of the amount due for each full
month of delinquency, up to a maximum penalty of thirty
per cent.
SECTION II. Sec. 12.23-1 of the Gilroy City Code is
adopted to read as follows:
Sec. 12.23-1 Penalty for delinquency
Whenever any garbage, rubbish or refuse collection fees
or charges collected by the city become delinquent for
not being paid for a period of one month, thereafter
there shall be imposed a monthly penalty equal to three
per cent of the amount due for each full month of
delinquency, up to a maximum penalty of thirty per cent.
SECTION III. Sec. 27.36-1 of the Gilroy City Code is
adopted to read as follows.:
Sec. 27.36-1 Penalty for delinquency
Whenever any water charges become delinquent for not
being paid for a period of one month, thereafter there
shall be imposed a monthly penalty equal to three
per cent of the amount due for each full month of
delinquency, up to a maximum penalty of thirty per cent.
SECTION IV. All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
SECTION V. This is an Emergency Ordinance which shall
take effect immediately upon its passage and approval. The

facts and circumstances giving rise to the emergency are as
follows:
Uniform delinquency penalties on all unpaid charges
and fees for city garbage, water and sewer services are
necessary and should take effect immediately so as to
permit automated billing procedures, decrease collection
expense for the citizens of Gilroy, and facilitate
collection procedures.
This Ordinance was introduced as an emergency measure and
passed and adopted to become effective immediately and ordered
published by title and summary in accordance with provisions
of the City Charter at a regular session of the City Council
held on the 17th day of March, 1969, by the following vote:

WENTWORTH and GOODRICH
