ORDINANCE NO. 851
ORDINANCE OF THE CITY OF GILROY AMENDING THE
ZONING ORDINANCE OF SAID CITY BY PREZONING
27.526 ACRES AS R-4 AND 3.471 ACRES AS C-1,
SAID PROPERTY BEING PART OF A PROPOSED AN-
NEXATION TO THE CITY OF GILROY
WHEREAS, the application has heretofore been made by HERMAN BERNS
and DORIS BERNS to the Planning Commission of the City of Gilroy
for the prezoning of 27.576 acres as R-4 (Medium Denisty Multiple
Family Residence) District and the prezoning of 3.471 acres as
C-1 (Neighborhood Commercial) District for property hereinafter
described; and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gilroy,
has held the hearing, and has made its report to the Council of
the City of Gilroy, in which it recommends that 27.520 acres of
the hereinafter described premises be prezoned as R-4 (Medium Density
Multiple Family Residence) District, and 3.471 acres be prezoned
as C-1 (Neighborhood Commercial) District; and
WHEREAS, the Council of the City of Gilroy has fixed the 17th
day of March, 1969, at Lhe hour of 8:00 o'clock P.M. in the Council
Chambers in the City Hall at No. 10 South Rosanna Street, Gilroy,
California, as the time and place for hearing the said report and
recommendation upon the said application, and notice of the said
hearing has been given in accordance with the said Zoning Ordinance,
and a public hearing has now been held upon the said application,
at the time and place fixed in the said notice, before the Council,
and the Council having duly considered the said application and the
evidence presented, and has determined that the said Zoning Ordi-
nance should be amended in accordance with the report of the said
Planning Commission,

NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN
AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy is
hereby amended by pre zoning to become effective on annexation and
placing in R-4 District, as the same is described and defined in
the Zoning Ordinance of the City of Gilroy, the following described
premises:
All of Assessor's parcels 786-14-7 and 786-14-8,
excepting therefrom a parcel of land comprised of
a strip of land 30 feet wide, lying within parcel
786-14-7 and extending along the Southerly boundary
of parcel 786-14-7 a distance of 420 feet from the
Westerly boundary of Monterey Highway, together with
the Easterly 420 feet of parcel 786-14-8.
CONTAINING 27.526 acres.
Section 2~ The Zoning Ordinance of the City of Gilroy is
hereby amended by prezoning to become effective upon annexation
and placing in C-1 District, as the same is described and defined
in the Zoning Ordinance of the City of Gilroy, the following des-
cribed premises~
All of the lands described in the foregoing
exception to Assessor's parcels 786-14-7 and
786-14-8.
CONTAINING 3.471 acres.
Section 3~ The official map constituting a part of the Zoning
Ordinance of the City of Gilroy shall be amended to reflect the
foregoing changes of classification of the said property.
Section 4~ All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
Section 5: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroy.
