ORDINANCE OF THE CITY OF GiLROY A}{ENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONING A 5.3 ACRE PARCEL
AS HC (HIGHWAY COM}~RCIAL) DISTRICT AND 94.7 ACRES AS
M2 (GENERAL INDUSTRIAL) DISTRICT ADJOINING %~E CITY
OF GILROY EAST OF TIiE SOUI~.I VALLEY FREEWAY BETWEEN
PAC}[ECO PASS HIGHWAY AND LUC}[ESSA AVENUE.
Wt~REAS, GEORGE NOLTE and ASSOCIATES have heretofore
filed with the Planning Con~ission of the City of Gilroy petition
Z 80-13 in due form requesting the prezoning of a 5.3 acre parcel
as HC (Highway Commercial) District and 94.7 acres as M2 (General
Industrial) District; and
Wq~REAS, the Planning Commission of the City of Gilroy
has given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gilroy, has
held the hearing, has approved an Environmental Impact Report, under
the California Environmental Quality Act, has determined tha~ with
mitigation measures as specified, the rezoning will not have a
significant adverse effect on the environment, and has made its
report to the Council of the City of Gilroy, in which it reco~m~ends
that the 100 acre parcel hereinafter described be prezoned as set
forth above; and
W}~REAS, the Council of the City of Gilroy has fixed the
5th day of January, 1981, at the hour of 8:00 o'clock p.m., in the
Council Chambers in the City Hall at 7351Rosanna Street, Gilroy,
California, as the time and place for hearing the said report and
recommendation upon the said application, and notice of the said
hearing has been given in accordance with the said Zoning Ordinance,
and a public hearing has now been held upon the said application
before the Council, and the Council having duly considered the said
application and the evidence presented, has approved the Environ-
mental Impact Report under the California Environmental Quality Act,

has determined that, with mitigation measures as specified, the
rezon£ng will not have a significant adverse effect on the environ-
ment, and has determined that the said Zoning Ordinance should be
amended in accordance w£th the report of the said Planning Commission.
NOW, ~REFORE, THE COUNCIL OF T}~ CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy
is hereby amended by prezoning to become effective upon annexation
and placing in HC and M2 Districts, as 'the same are described and
defined in the Zoning Ordinance of the City of Gilroy, the following
described premises:
To HC, the most northerly 5.3 acres; and
to M2, the balance of all that property
located in the County of Santa Clara, State
of California, described as follows:
Parcels comprising 100 acres, more or less,
east of the South Valley Freeway between
Pacheco Pass Highway and Luchessa Avenue,
being Santa Clara County Assessor's Parcel
Nos. 841-15-11 and 12, 841-16-45 and 80
and 841-17-31.
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to reflect
the foregoing changes of classification of the said property.
Section 3: All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroy.

certify that the attached Ordinance No. 81-2 is an original ordinance,
duly adopted by the Council of the City of Gilroy at a regular meeting of
said Council held on the 19th day of January , 19 81.., at which
meeting a quorum was present.
