ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY REZONING 1.27 ACRES FROM
Ri (SINGLE FAMILY RESIDENCE) DISTRICT TO Ri PUD
(SINGLE FAMILY RESIDENCE PLANNED UNIT DEVELOPMENT)
DISTRICT AND PREZONING 10.87 ACRES AS RI PUD (SINGLE
FAMILY RESIDENCE PLANNED UNIT DEVELOPMENT) DISTRICT
ADJOINING THE CITY OF GILROY ON THE NORTH SIDE OF
MANTgLLI DRIVE 2200 FEET WEST OF MOREY AVENUE.
WI{EREAS, BERT MANTELLI, et al, has heretofore filed with
the Planning Commission of the City of Gilroy petition Z 81-2 in
due form requesting the rezoning and prezoning of 12.14 acres as
RI PUD (Single Family Residence Planned Unit Development) District;
and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the said application, in
accordance with the Zoning Ordinance of the City of Gilroy, has
held the hearing, has approved a Negative Declaration under the
California Environmental Quality Act, and has made its report to
the Council of the City of Gilroy, in which it recommends that the
12.14 acres hereinafter described be rezoned and prezoned as set
forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the
2nd day of March, 1981,.at the hour of 8:00 o'clock p.m. in the
Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy,
California, as the time and place for hearing the said report and
recommendation upon the said application, and notice of the said
hearing has been given in accordance with the said Zoning Ordinance,
and a public hearing has now been held upon the said application,
and the Council having duly considered the said application and the
evidence presented, has approved the Negative Declaration under the
California Environmental Quality Act, and has determined that the
said Zoning Ordinance should be amended in accordance with the report
ORDINANCE NO. 81-10 -1-
of the said Planning Commission.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
Section ~: The Zoning Ordinance of the City of Gilroy
is hereby amended by rezoning 1.27 acres~by prezoning 10.87 acres
to become effective upon annexation and placing five acres in Ri
PUD District, as the same is described and defined in the Zoning
Ordinance of the City of Gilroy, the following described premises:
Ail that property located in the County of Santa
Clara, State of California, described as follows:
Those 1.27 and 10.87 acre parcels on the North
side of Mantelli Drive 2200 feet West of Morey
Avenue, and shown as parcels 783-21-12 and 13
in the Santa Clara County Tax Assessor'~s MaP
Book.
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to
reflect the foregoing changes of classification of the said
property.
Section 3: Ail ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and
approval, with zoning of the prezoned parcel to become effective
upon annexation of said property to the City of Gilroy.
