ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONING AN 8.4 ACRE PARCEL
AS C2 PUD (GENERAL COMMERCIAL PLANNED UNIT DEVELOPMENT)
DISTRICT AND 1o4 ACRES AS M2 (GENERAL INDUSTRIAL) DISTRICT
ADJOINING THE CITY OF GILROY AT T~ SOUTHEAST CORNER OF
TENTH AND ALEXANDER STREETS°
WHEREAS, FILBRO DEVELOPMENT COMPANY has heretofore filed
with the Planning Commission of the City of Gilroy petition Z 78-13
in due form requesting the prezoning of an 8°4 acre parcel as C2
PUD (General Commercial Planned Unit Development) District and 1.4
acres as M2 (General Industria~ District; and
WHEREAS, the Planning Commission of the City of Gilroy
has given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gilroy, has
held the hearing, has approved a Negative Declaration under the
California Environmental Quality Act, has determined that, with
mitigation measures as specified, the rezoning will not have a
significant adverse effect on the environment, and has made its
report to the Council of the City of Gilroy, in which it recommends
that the 9°8 acre parcel hereinafter described be prezoned as set
forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the
6th day of April, 1981, at the hour of 8:00 o'clock pom., in the
Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy,
California, as the time and place for hearing the said report and
recommendation upon the said application, and notice of the said
hearing has been given in accordance with the said Zoning Ordinance,
and a public hearing has now been held upon the said application
before the Council, and the Council having duly considered the said
application and the evidence presented, has approved the Negative
Declaration under the California Environmental Quality Act, has
determined that, with mitigation measures as specified, the rezoning

will not have a significant adverse effect on the environment,
and has determined that the said Zoning Ordinance should be amended
in accordance with the report of the said Planning Commission°
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy
is hereby amended by prezoning to become effective upon annexation
and placing in C2 PUD and M2 Districts, as the same are described
and defined in the Zoning Ordinance of the City of Gilroy, the
following described premises:
To C2 PUD, the most northerly 8°4 acres; and
to M2, the balance of all that property located
in the County of Santa Clara, State of California,
described as follows:
A 9°8 acre parcel, more or less, at the southeast
corner of Tenth and Alexander Streets, being Santa
Clara County Assessor's Parcel Noo 841-16-048o
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to reflect
the foregoing changes of classification of the said property°
Section 3: All ordinances and parts of ordinances in
conflict herewith are hereby repealed°
SeCtion 4: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroyo
