Ordinance 1981-14ORDINANCE NOo 81-14 ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 1, 2, 5 AND 9 OF ORDINANCE NOo 79-28, THE RESIDENTIAL DEVELOPMENT ORDINANCE° THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: SECTION Io Sections 1, 2, 5 and 9 of the Residential Development Ordinance No. 79-28 are amended to read as follows: Section 1. Findings; by adding the following paragraphs B and C and redeslgnating existing paragraphs B through G, inclusive, as D through I, inclusive: B c The population of the City of Gilroy grew by sixty- eight (68) percent from 1970 to 1980, while the pouplation of the Santa Clara County region grew by twenty (20) percent° Gilroy increased its supply of residential dwellings by eighty-seven (87) percent from 1970 to 1980, while Santa Clara County increased its supply by forty (40) percent. The City provides many housing programs to improve housing and provide adequate sites for all economic segments of the community. The City supports housing rehabilitation, construction of assisted housing, and rental assistance programs, for low and moderate in- come residents. Section 2~ Statement of Intent; by adding the following paragraphs D and E and redesignatihg 'existing paragraph D as F. Do Provide and maintain an appropriate share of the regional need for housing° g ° Provide and maintain housing programs and activities to enable the City to meet the needs of all economic segments of the community. Section 5~ Annual Numerical Limits; by amending paragraph A to read as follows: A° Criteria for Setting Numerical Limits Once each year, the City Council shall, after con- sidering economic, public service, environmental, housing, and other studies relevant to the residen- tial development program, determine the maximum and minimum number of dwelling units which may be issued building permits, consistent with the purpose and intent of this Ordinance as set forth in Section 2o The minimum limit allowed shall be based on the regional population and residential dwelling growth rate for Santa Clara County. Gilroy's appropriate share of the regional need for housing shall be equal ORDINANCE NO o 81-14 -1- to or greater than the annual percentage increase in dwelling units for the County as a whole, and reflect the City's industrial growth rate° In setting the Numerical Limits, the City Council shall also consider the number of units previously issued permits under assigned build-out schedules and units previously permitted as exceptions to this ordinance° Said Numerical Limits shall be set in accordance with the procedures of Paragraph B, following. The Numerical Limits shall be ex- pressed as the total number of dwelling units, for projects not exempted by Section 4, which may be permitted in a specified calendar year° Section 9~ Competitive Evaluation & Ranking Procedures; by amending paragraph ~ 1 to read"as f~'16~'~ ....... - ~ Co lo The maximum Numerical Limit for any year need not be fully allocated° SECTION IIo Ail other ordinances and parts of ordinances in conflict herewith are hereby repealed° SECTION IIio This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
