ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY REZONING 45.65 ACRES FROM
Ri (SINGLE FAMILY RESIDENCE) DISTRICT TO RH (HILLSIDE
RESIDENTIAL) DISTRICT AND BY PREZONING 23.73 ACRES AS
RI{ (HILLSIDE RESIDENTIAL) DISTRICT AND 8.2 ACRES AS
Ri PUD (SINGLE FAMILY RESIDENCE PLANNED UNIT DEVELOP-
MENT) DISTRICT ADJOINING THE CITY OF GILROY ON THE
SOUTH SIDE OF MANTELLI DRIVE AND THE NORTH SIDE OF
HECKER PASS HIGHWAY WEST OF MOREY AVENUE.
WHEREAS, FILICE ESTATE VINEYARDS, et al, have heretofore
filed with the Planning Commission of the City of Gilroy
petition Z 81-5 in due form requesting the rezoning of 45.65
acres from RI District to RH District and the prezoning of
23.73 acres as RH District and 8.2 acres as Ri PUD District;
and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the said application, in
accordance with the Zoning Ordinance of the City of Gilroy, has
held the hearing, has approved a Negative Declaration under the
California Environmental Quality Act, and has made its report to
the Council of the City of Gilroy, in which it recommends that the
77.58 acres hereinafter described be rezoned and prezoned as set
forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the
1st day of June, 1981, at the hour of 8:00 o'clock p.m. in the
Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy,
California, as the time and place for hearing the said report and
recommendation upon the said application, and notice of the said
hearing has been given in accordance with the said Zoning Ordinance,
and a public hearing has now been held upon the said application,
and the Council having duly considered the said application and the
evidence presented, has approved the Negative Declaration under the
California Environmental Quality Act, and has determined that the
said Zoning Ordinance should be amended in accordance with the report
ORDINANCE NO. 81-18
of the said PEnning Commission. ~
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy
is hereby amended by removing from Ri District and placing in
RH District and by prezoning as RH and Ri PUD Districts to
become effective upon annexation, as those Districts are described
and defined in the Zoning Ordinance of the City of Gilroy, the
following described premises:
Ail that property located in the County of
Santa Clara, State of California, described
as follows:
From RI to RH parcels to 2, 3 and 5 totalling
45.65 acres and to RH and R1 PUD, parcel 4
as shown in the attached map of the
subject property between Hecker Pass Highway
and Mantelli Drive west of Morey Avenue,
being Santa Clara County Assessors Parcels
Nos. 783-02-003 and 783-03-001, 015, 020 and 021.
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to reflect
the foregoing changes of classification of the said property.
Section 3: Development of the described property shall be
limited to two residences until completion of proposed Project 566
drainage improvements in the area.
Section 4: All ordinances and parts of ordinances in con-
flict herewith are hereby repealed.
Section 5: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval, with
zoning of the prezoned parcel to become effective upon annexation
of said property to the City of Gilroy.
PASSED AND ADOPTED this 15th day of June, 1981, by the
