ORDINANCE OF THE CITY OF GILROY AMENDING SECTIONS 5,
8 and 9 OF ORDINANCE NO. 79-28, THE RESIDENTIAL
DEVELOPMENT ORDINANCE.
THE CITY COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS
FOLLOWS:
SECTION I. Sections 5, 8 and 9 of the Residential
Development Ordinance No. 79-28, as amended by Ordinance
No. 81-14, are amended to read as follows:
Section 5, Annual Numerical Limits; by amending Paragraph A
to read as follows:
A. Criteria for Setting Numerical Limits
Once each year, the City Council shall, after considering
economic, public service, environmental, housing, and
other studies relevant to the residential development
program, determine the maximum number of dwelling units
which may be issued building permits, consistent with
the purpose and intent of this Ordinance as set forth
in Section 2. In setting the Numerical Limits, the
City Council shall also consider the number of units
previously issued permits under assigned build-out
schedules and units previously permitted as exceptions
to this ordinance. The numerical ltmitestablished~
by the City Council shall provide for an adequate
number of dwelling units to meet or exceed the.CitF's
regional need for housing as established by State of
California requirements. Said Numerical Limits shall
be set in accordance with the procedures of Paragraph B,
following. The Numerical Limits shall be expressed as
the total number of dwelling units, for projects not
exempted by Section 4, which may be permitted in a
specified calendar year.
Section 8, The Project Rating Scale; by amending the section
to read' ~s follows:
The competitive evaluation of proposed residential development
projects shall be based upon point scores assigned in accord
with the Project Rating Scale which shall be adopted from time
to time by resolution of' the City Council.
Section 9, Competitive Evaluation & Ran~tng Procedures; by
amending paragra~'h'C 2 to read as fOllows:

Build-out schedules shall not be assigned for more
than three (3) years, nor shall any individual

project be assigned more than 25% (twenty-five
percent) of the Numerical Limit for each year
of the build-out schedule. Any building permits
not issued in the assigned calendar year will
automatically extend the build-out, for each project,
for one year following the final year of the build-out
schedule. The City Council may grant only one
additional one year build-out schedule extension for
each project, only if the City Council finds that
the lack of progress is due to a situation beyond the
control of the developer. A build-out schedule must
expire before a new application for the annual
competition can be accepted for those same specific
dwelling units.
SECTION II. All other ordinances and parts of ordinances
in conflict herewith are hereby repealed.
SECTION III. This ordinance shall take effect and be in
full force thirty (30) days from and after its adoption and approval.
