Ordinance 1982-08 ORDINANCE NO. 82-8 ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING ORDINANCE OF SAID CITY BY PRE. ZONING A 370.842 ACRE PARCEL ADJOINING THE CITY OF GILROY ON THE NORTH SIDE OF HECKER PASS HIGHWAY, EAST OF THE GILROY GOLF AND COUNTRY CLUB AS RH (HILLSIDE RESIDENTIAL) DISTRICT. WHEREAS, SIG SANCHEZ has heretofore filed with the Planning Commission of the City of Gilroy petition Z81-13 in due form requesting the prezoning of a 370.842 acre parcel as RI{ (Residential Hillside) District; and, WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has recommended certification of an Environmental Impact Report under the California Environmental Quality Act, and has made its report to the Council of the City of Gilroy, in which it recommends that the 370.842 acre parcel hereinafter described be prezoned as shown in the application and as set forth above; and WHEREAS, the Council of the City of Gilroy has fixed the 1st day of March, 1982, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said Zoning Ordinance, and a public hearing has now been held upon the said application before the Council, and the Council having duly considered the said application and the evidence presented, has certified the Environmental Impact Report under the California Environmental Quality Act, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission. ORDINANCE NO. 82-8 NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section 1: The Zoning Ordinance of the City of Gilroy is hereby amended by prezontng to become effective upon annexation and placing in RH District as shown in the application and as the same are described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: Ail that property located in the County of Santa Clara, State of California, described as follows: That 370.842 acre parcel on the north side of Hecker Pass Highway, East of the Gtlroy Golf and Country Club being Santa Clara County Assessor's Parcels Nos. 783-04-001, 009, 012, 013 and 014. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the foregoing changes of classification of the said property. Section 3: Ail ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4: This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval, and upon annexation of said property to the City of Gilroy.
