ORDINANCE OF THE CITY OF GILROY AMENDING
THE ZONING ORDINANCE OF SAID CITY BY PREZONING
A 97.4 ACRE PARCEL ADJOINING THE CITY OF GILROY
AT THE WESTERN TERMINUS OF MANTELLI DRIVE,
WEST OF MOREY AVENUE, AS RH (RESIDENTIAL HILLSIDE)
DISTRICT AND R1 PUD (SINGLE FAMILY RESIDENTIAL
PLANNED UNIT DEVELOPMENT) DISTRICT.
WHEREAS, BERT MANTELLI has heretofore filed with
the Planning Commission of the City of Gilroy petition Z81-16
in due form requesting the prezoninK of a 97.4 acre parcel
as RR (Residential Hillside) District and RI PUD (SFRPUD) District;
and,
WHEREAS, the Planning Commission of the City of
Gilroy has given due notice of a public hearing upon the said
application, in accordance with the Zoning Ordinance of the City
of Gtlroy, has held the hearing, has recommended certification
of an Environmental Impact Report under the California Environmental
Quality Act, and has made its report to the Council of the City
of Gilroy, in which it recommends that the 97.4 acre parcel
hereinafter described be prezoned as shown in the application and
set forth above; and
WHEREAS, the Council of the City of Gtlroy has fixed
the 15th day of March, 1982, at the hour of 8:00 o'clock p.m.,
in the Council Chambers in the City Hall at 7351 Rosanna Street,
Gilroy, California, as the time and place for hearing the said
report and recommendation upon the said application, and notice
of the said hearing has been given in accordance with the said
Zoning Ordinance, and a public hearing has now been held upon the
said application before the Council, and the Council having duly
considered the said application and the evidence presented, has
certified the Environmental Impact Report under the California
Environmental Quality Act, and has determined that the said
Zoning Ordinance should be amended in accordance with the report
of the said Planning Commission.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of
Gilroy is hereby amended by prezoning to become effective upon
annexation and placing in RH and R1 PUD Districts as shown in the
application and as the same are described and defined in the
Zoning Ordinance of the City of Gilroy, the following described
premises:
Ail that property located in the County
of Santa Clara, State of California,
described as follows:
That 97.4 acre parcel at the western terminus
of Mantelli Drive west of Morey Avenue being
Santa Clara County Assessor's Parcel No.
783-21-020.
Section 2: The official map constituting a part of
the Zoning Ordinance of the City of Gilroy shall be amended to reflect
the foregoing changes of classification of the said property.
Section 3: All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroy.
