ORDINANCE OF THE CITY OF GILROY AMENDING THE
ZONING ORDINANCE OF SAID CITf BY PREZONING A
32.45 ACRE PARCEL ADJOINING THE CITY OF GILROY
SOUTHEAST OF THE INTERSECTION OF HIGHWAY 101
AND MONTEREY STREET AS M2 (GENERAL INDUSTRIAL)
DISTRICT
WHEREAS, NOB HILL FOODS, INC., has heretofore filed
with the Planning Commission of the City of Gilroy petition
Z82-2 in due form. requesting the prezoning of a 32.45 acre
parcel as M2 (General Industrial) District; and,
WHEREAS, the Planning Commission of the City of
Gilroy has given due notice of a public hearing upon the said
application, in accordance with the Zoning Ordinance of the
City of Gilroy, has held the hearing, has noted prior
certification of an Environmental Impact Report under the
California Environmental Quality Act, and has made its report
to the Council of the City of Gilroy, in which it recommends
that the 32.45 acre parcel hereinafter described be prezoned
as shown in the application and as set forth above; and
WHEREAS, the Council of the City of Gilroy has fixed
the 7th day of September, 1982, at the hour of 8:00 o'clock p.m.,
in the Council Chambers in the City Hall at 7351 Rosanna Street,
Gilroy, California, as the time and place for hearing the said
report and reco~endation upon the said application, and
notice of the said hearing has been given in accordance with
the said Zoning Ordinance, and a public hearing has now been
held upon the said application before the Council, and the
Council having duly considered the said application, the evidence
presented and The prior certification of an Environmental
Impact Report under the California Environmental Quality Act,
has determined that the said Zoning Ordinance should be amended
in accordance with the report of the said Planning C~ission.
ORDINANCE NO. 82-21
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of
Gilroy is hereby amended by prezoning to become effective upon
annexation and placing in M2 District as shown in the applica-
tion and as the same are described and defined in the Zoning
Ordinance of the City of Gilroy. the followin~ described
premises:
All that propert7 located in the County
of Sabra Clara, State of California,
described as follows:
That 32.45 acre parcel southeast of the
intersection of Highway 101 and Monterey
Street, beir~ Santa Clara County Assessor's
Parcels Nos. 841-14-42, 43, 46 and 49.
Section 2: The official map constituting a part of
the Zoning Ordinance of the City of Gtlroy shall be amended to
reflect the foregoing changes of classification of the said
property.
Section 3: All ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and
approval, and upon annexation of said property to the City of
Gilroy.
